국문 초록

우리나라와 중국, 일본의 해역은 상대국과의 거리가 그 어느 곳도 400해리를 초과하지 않고 각 국은 대륙붕경계획정의 근거를 서로 달리 주장하고 있기 때문에 한․중․일간의 대륙붕경계획정은 매우 어려운 현실이다. 가까운 미래에 세 국가사이에 대륙붕의 경계획정 문제는 야기될 것이다. 이 논문은 해양경계획정 연구를 통해 우리나라 주변 대륙붕 경계획정에 적용가능한 원칙에 대하여 고찰하는데 목적이 있다. 연구목적을 위해 대륙붕경계획정에 적용가능한 다양한 국제법 원칙과 국제재판사례들을 검토한다.

영문 초록

The boundary delimitation of the Continental Shelf between Korea, China, Japan is very difficult. Because the distance of three states is less than 400NM and each state insists on the different principles of the delimitation of the Continental Shelf. In the near future, it is possible to arise the dispute about the delimitation of the Continental Shelf between the three states. The purpose of this thesis is to examine the reasonable and fair principles applicable to the boundary delimitation of the Continental Shelf around the Korean peninsula through the positive study of maritime boundary. To achieve this purpose, several general principles of international law applicable to the boundary delimitation of the Continental Shelf are examined comprehensively in their scopes and international cases as decided by the International Court of Justice or the Court of Arbitration are examined.
