선원최저임금제도 개선에 관한 연구

국문 초록

이 논문은 국적선원과 외국인선원간의 최저임금의 차이로 인한 균등처우 위반 문제가 국가인권위원회에 두 차례 제기되었고, 최근 부산지방법원 등의 사건에서도 제기되었는 바, 이에 대한 검토와 해결방안을 연구 제시하는 것을 목적으로 한다. 차별금지와 관련한 국제노동기구의 규범을 살펴보면, 근로자의 국적에 따른 차별금지 조항을 두고 있지 않다. 주요 해운국은 외국인선원의 근로조건에 대하여 단체협약으로 별도로 정하도록 하는 법제를 두고 있다. 제정 선원법은 국 적에 따른 차별금지 규정을 두고 있지 않다가, 1984년 9월 선원법 전면개정시 당시 근로기준법에 규정되어 있었던 균등처우 규정을 인용함으로써 국적에 따른 차별금지 규정이 도입되게 되었는데, 이는 당시 국적선에 외국인선원이 전혀 승선하지 않았던 여건에 따라 부주의하게 입법되게 된 것으로 보인다. 임금지불에 있어 자국민과 외국인을 달리 대우하는 것은 국제해운계의 일반적 거래관행이며, 다수의 선진국의 경우에도 최저임금에 있어서 자국민과 외국인에 대하여 차별을 하고 있다. 이는 합리적 차별의 범주에 든다고 할 것이다. 그러므로 외국인선원의 최저임금 수준을 국적선원의 그것에 비하여 낮게 책정하기로 하는 노사간의 합의가 있다면 최저임금을 설정하여 고시할 때 이 점은 고려될 필요가 있을 것이다. 이는 근로기준법상 균등처우의 일반적 법리와는 다른 선원법상 균등처우의 특별한 법리로 이해되어야 한다. 다만, 국민과 외국인에 대하여 최저임금을 달리 정할 수 있도록 규정하고 있는 장관고시에 대한 시비를 해결하기 위해서는 노사의 협의를 거쳐 국적선원과 외국인선원 모두에게 적용될 수 있는 최저임금 예컨대, 국제노동기구에서 공표한 유능부원의 최저 기본임금을 반영하여 재설정하도록 하는 것이 바람직하다.

영문 초록

Recently there have been two appeals requesting the National Human Rights Commission of Korea to resolve the problems of breach of equal remuneration principle due to discrimination of minimum wages between national and foreign seafarers and a similar case was also submitted by foreign seafarers against shipowners to Busan district court. This paper intends to study the problems concerned and propose the revision of minimum wage system in order to address the issues. Looking at the ILO's instruments relating to the non-discrimination or equal remuneration, there are no provisions prohibiting expressly the discrimination based on nationality of workers. Major shipping nations have legal system whereby the working conditions of non-nationals can be determined separately through collective bargaining agreement. The initially enacted Seafarers' Act did not have non-discrimination provisons based on the nationality of seafarers. However, September 1984 amendment to the Seafarers' Act introduced non-discrimination provisons based on the nationality of seafarers, through referencing the equal remuneration provisons stipulated in the Labour Standards Act. It is believed to be negligently revised without giving proper consideration to the result of the amendment owing to the fact that there were no foreign seafarers employed on Korean flag ships. In paying wages, it is a general practices in international shipping industry that wage levels are set differently between national and non-national seafarers and many advanced countries do not prohibit differing minimum wage levels between nationals and non-nationals. This can be regarded as a kind of rational and acceptable discrimination. Therefore it needs to be taken into consideration where there is an agreement between social partners that the minimum wage levels for non-nationals are less than those of nationals when setting out and issuing the minimum wage levels. One must understand that the legal principle of equal remuneration in the Seafarers' Act is special and different from the general legal principle of equal remuneration in general Labour Standards Act. However, in order to avoid possible legal disputes regarding the ministerial notice which expressly permits that the minimum wage level for foreign seafarers can differently be determined from that of national seafarers, the author recommends to establish a single minimum wage level, by reflecting the minimum basic wage figure for able seafarers set and notified by ILO, that could be applicable to all seafarers regardless of nationalities of seafarers after consultation with social partners.
