국문 초록

크루즈 관광산업은 고부가 가치 창출산업으로서 급속하게 성장하고 있는 관광산업이다. 세계관광기구(World Tourism Organization)도 항공과 크루즈 관광산업은 2020년까지 증가할 것으로 예측하고 있으며, 크루즈선 승객 1명당 발생하는 부가가치는 컨테이너 1개와 같은 효과가 발생한다는 연구보고도 있다. 그동안 북미 및 유럽지역을 중심으로 성황하던 크루즈 관광산업은 아시아지역으로 이동하고 있으며, 우리나라에 입항하는 크루즈선은 꾸준하게 늘고 있는 상황이다. 그러나 경제적 이점과는 반대로 크루즈선의 대형화와 수적증가는 해양환경 측면에서 대량의 폐기물 및 오염물질을 배출하는 새로운 오염원으로 부상하고있다. 선진국에서는 전 세계 상선선대의 1%를 차지하는 크루즈선이 상선대에서 발생하는 폐기물의 25%를 차지할 만큼 엄청난 오염물질을 배출함을 지적하며 이를 방지하기 위한 노력을 촉구하고 있다. 또한 크루즈선 오염문제를 뒷받침 하듯 크루즈선 내에서 발생하는 오염물질의 불법배출로 인해 연안국 및 공해의 해양환경이 위협받는 사례가 빈번하게 발생하고 있다. 따라서 이 논문에서는 아직까지 우리에게 생소한 크루즈 산업의 특징과 크루즈선기인 오염물질의 환경영향을 알아본다. 그리고 현재 발효된 선박기인 오염물질 규제 국제법 검토를 통해서 크루즈선기인 오염물질의 문제점을 고찰해 보고자 한다. 또한 크루즈 관광산업이 일찍이 발전한 미국의 관련 입법 분석을 통해 해양환경관리법상 크루즈선기인 오염물질 규제의 문제점을 도출해 보고 이를 해결하기 위한 개선방안을 제시하고자 한다.

영문 초록

Cruise tourism industry, a high value-added industy, is rapidly growing in the overall tourism industry. World Tourism Organization expected that the aviation and cruise industry would continually develop until 2020 year. According to the research, a passenger of the cruise creates the value corresponding to one container transport. Presently, Asia is a fast emerging market compared to North America and Europe region, the cruise tourism and the number of cruise ship visiting to the Republic of Korea also continue to increase. However, on the contrary to economic advantage, large cruise ships and a number of the ships are considered as the new marine pollutant source at the aspect of marine environment. Cruise ships occupy less than 1% of the global merchant fleet but they are responsible for 25% of all waste generated by merchant vessels. Furthermore, the pollution occurred by illegal discharge from cruise ships frequently takes place and also it threatens the marine environment of coast state and high sea. The purpose of this paper is to investigate the characteristic of cruise tourism and the effect of pollutants discharged from cruise ship. Also, it is to consider the problems of the control and regulations with respect to cruise ship pollution through the review of the international laws and United States laws. Consequently, it suggests the way forward to improve and supplement in Marine Environment Management Act in order to control and regulate the pollutants in Korea jurisdictional sea area.
