선박건조보험약관에 있어서 건조보험자의 면책사유에 관한 연구

국문 초록

선박건조자인 조선소와 발주자인 선박소유자간에 체결되는 선박건조계약은 일종의 도급계약인데, 선박건조자가 선박을 건조하여 이를 발주자에게 인도할때까지의 사이에 화재, 풍수해, 전복, 침몰, 충돌 등의 여러 위험에 노출되게 되는데, 이러한 위험은 선박건조자가 부담하게 된다. 따라서 선박건조자는 건조중인 선박에 노출되어 있는 육상위험과 해상위험을 담보하기 위하여 건조보험자와 선박건조보험계약을 체결하는데, 현재 우리나라의 대부분의 조선소에서는 영국의 런던보험자협회에서 제정한 협회선박건조보험약관(Institute Clauses for Builders' Risks; 이하에서는 “선박건조보험약관”이라고 약칭한다.)을 선박건조보험계약의 표준약관 또는 기본약관으로 가장 많이 사용하고 있다. 한편 선박건조보험약관 제5조(담보위험)에서 “이 보험은 피보험목적물에 대한 멸실 또는 훼손의 모든 위험을 담보한다.”고 규정하여, 모든 위험을 담보하는 포괄책임방식을 채택하고 있다. 따라서 선박건조보험약관상 건조보험자의 면책사유의 내용을 명확하게 이해할 필요가 있는데 이를 위해서는 면책사유에 대한 해석론적 검토가 무엇보다 중요하다. 이 논문에서는 선박건조보험 업무에서 쉽게 이해하고 접할 수 있는 자료를 제공하기 위하여 선박건조보험약관상의 건조보험자 면책사유의 주요 내용을 해석론적으로 고찰하고자 한다.

영문 초록

The ship building contract made between a builder(a shipbuilding company) and a buyer(the owner of the shipbuilding project) is a kind of contract for construction works. The shipbuilding company is exposed to various dangers such as fire, strong wind, capsize, sinking and collision from the time of the completion of the shipbuilding to its hand‐over to the owner. The shipbuilder shall be responsible for those losses and damages until it is successfully handed over to the owner. Thus, shipbuilders purchase Ship Building Insurance to be protected from land risks and marine risks. Currently, in Korea, most of shipbuilders use Institute Clauses for Builders' Risks by Institute of London Underwriters in UK (“Clauses for Builders' Risks” hereunder) as standard or basic policy of shipbuilding insurance. It adopts all risks coverage by defining “This insurance is against all risks of loss of or damage to the subject‐matter insured” in Section 5(Perils) of the Clauses for Builders' Risks. Accordingly, we need to understand the exclusion causes of the shipbuilding insurer more clearly and interpretative review becomes the most important for this purpose. Accordingly, in this paper, the main contents of exclusion causes of the shipbuilding insurer on the Clauses for Builders' Risks will be reviewed from the perspective of interpretation so that we can understand and access to shipbuilding insurance more easily.
