국문 초록

해적행위와 해상테러에 대비하기 위해 국제사회는 다양한 대응수단을 마련하기 위한 노력을 활발하게 하고 있고, 우리나라도 관련 법령을 정비하는 등 국제적 협력을 다하고 있다. 즉, 국제사회는 해적행위와 해상테러를 실효적으로 규제하기 위하여 유엔해양법협약과 IMO 해사협약 등 국제적 규범을 채택․시행하고 있고, 우리나라를 포함한 미국, 일본, 중국 등 주요 국가들은 해적행위 및 해상테러를 규제하기 위한 국내법의 제정 또는 개정을 통해 적극 대처하고 있다. 그러나 우리나라는 아직 이러한 위해를 완전히 극복할 수 있는 법제적 준비가 되어 있지 않은 상황이다. 따라서 해적행위 및 해상테러 규제를 위하여 국제협약에 따른 국내법의 개정은 물론 법제적 역량강화를 위한 절차법의 제정이 시급히 필요하다.

영문 초록

International society is making every endeavor to prepare various countermeasures against piracy and maritime terrorism, and the Republic of Korea is also making every efforts for international cooperation such as correction and legislation of national laws concerned. International society, that is to say, is adopting and implementing international norm such as United Nations on the Law of the Sea, 1982 and International Maritime Organization conventions, etc. for the effective control of piracy and maritime terrorism. And world major countries like the United States of America, Japan, Chine including the Republic of Korea are taking positive measures for the restriction of piracy and maritime terrorism through the correction and legislation of national laws. However, the Republic of Korea didn't take legal and systematic preparations to recover this kind of harms yet. Therefore, it is urgently necessary to correct national law concerned based on international conventions and making procedural law for strengthening of legal and systematic capability for the control of piracy and maritime terrorism.
