국문 초록

우리나라는 해양이라는 특수한 공간적 상황에서 발생하는 각종 해양안보위협으로부터 전문적이고 체계적으로 대응하기 위해서 국토해양부 소속하에 해양경찰청을 설치 및 운영하고 있다. 이러한 해양경찰은 해양주권수호와 해양자원보호를 위한 해양경비업무를 주도적으로 수행하고 있으나, 해양경비 활동에 대한 구체적인 근거법이 미비하여 효과적인 업무수행에 많은 한계가 있어 왔다. 이에 따라 그동안 해양경찰의 기본적 활동에 속하는 해양경비업무에 대한 독자적인 근거법 제정의 필요성이 지속적으로 제기되었으며, 그 결과 지난 2012년 2월 22일 제18대 국회에서 ｢해양경비법｣이 제정되었으며, 2012년 8월 23일에 동법의 시행을 앞두고 있다. 따라서 이 논문에서는 ｢해양경비법｣ 제정의 당위성 및 외국의 입법례를 살펴보고, 해양경비 활동과 관련된 주요 내용을 조문별로 검토한다. 그리고 이를 중심으로 향후 우리나라 해양경찰의 기능강화 방안을 제시한다.

영문 초록

Korea has established the Korea Coast Guard belonging to the Ministry of Land, Transport and Maritime Affairs for the professional and systematic response to various threats against maritime security occurring in the special spatial situations at sea. The Korea Coast Guard is taking the initiative in ensuring maritime security for the protection of maritime sovereignty and marine resources, but there have been many limitations in the effective execution of work due to the insufficiency of concrete legal basis on activities of maritime security. Therefore, the necessity of enacting of an independent applicable Act on maritime security, which belongs to the basic activities of the Korea Coast Guard, has been constantly raised. As a result, on February 22nd, 2012, 'Maritime Security Act' was enacted by the 18th National Assembly, which is scheduled to be implemented on and after August 23rd, 2012. Accordingly, this paper examines the justification and similar cases of foreign countries of enactment of 'the Maritime Security Act' and reviews the main contents of it related to activities of coast defense article by articles. In addition, this paper presents the plans for strengthening the functions of Korean Coast Guard with special emphasis on that.
