국문 초록

지속적인 고유가와 해양분야의 기술발전에 따라 해양플랜트에 대한 수요는 점점 증가할 것으로 기대된다. 최근 우리나라는 에너지 자원의 자급비율을 높이기 위해서 국내외적으로 많은 지역에 대한 에너지 탐사, 굴착을 비롯하여 해외 유전에 대한 지분 인수 등의 적극적인 활동을 하고 있다. 따라서 해양에너지 분야에 대한 신규프로젝트 발주가 증가함에 따라 수반되어 발생하는 사고의 규모와 피해는 단순한 해난사고의 범위를 벗어난 대재앙 수준에 이르고 있다. 이러한 막대한 규모의 재정과 환경적 피해가 발생할 수 있는 해양플랜트공사에 있어서 피보험자인 발주자 또는 해양플랜트공사에 참여하는 다양한 계약자를 담보해주고 이를 통해서 해양플랜트공사계약이 원활하게 진행될 수 있도록 안전장치 역할을 하는 것이 해양플랜트공사보험이다. 그러나 현재 우리나라에는 이러한 해양플랜트공사를 진행하는데 필요한 특수보험이 없는 실정이다. 따라서 이 논문에서는 해양플랜트공사와 관련하여 국제적으로 통용되고 있는 WELCAR 2001 해양플랜트공사보험을 토대로 해양플랜트공사보험의 특성과 범위 그리고 중요약관에 대해서 해석론적으로 고찰하고자 한다. 더불어 향후 국내에서 발주되고 운용될 해양플랜트에 적용할 수 있는 국문해양플랜트공사보험약관을 제정·시행함 있어서 필요한 법적 기초자료를 제공하는 것을 목적으로 하고 있다.

영문 초록

According to the continuous high oil price and the development in technology of the marine field, the demand for the offshore plant is expected to likely grow gradually. These days, our country is being positively active in taking an equity stake of overseas oil field including energy exploration and drilling in many regions at home and abroad in order to increase the self-sufficiency ratio of energy resource. Accordingly, the scale and damage, which take place by being accompanied according to a rise in ordering of the ocean energy, are reaching the catastrophic level escaping from the range of simple marine accident. The offshore plant construction insurance is what guarantees the ordering body, who is the insured, and diverse contractors, who participate in offshore plant, and what plays a role of safety device so that the offshore plant construction contract can be progressed smoothly through this in the offshore plant construction that can be created this huge scale of finance and the environmental damage. However, it is the real situation that there is no speciality insurance now necessary for progressing this offshore plant construction in our country. Accordingly, this study aims to consider theoretically on the insurance characteristics, scope and the constitutional contents based on the WELCAR 2001 offshore plant construction insurance clause, which is being commonly used internationally in relation to the offshore plant construction. In addition, the aim is to offer legal basic data necessary for enacting and enforcing the offshore plant construction insurance clause in Korean, which can be applied to the offshore plant that will be ordered and operated domestically in the future.
