국문 초록

3면이 바다인 우리나라는 대부분의 연안해역 주변으로 수산동식물을 포획․ 채취하면서 생계를 유지해 나갈 수 있도록 어업인들에게 마을어업권 등을 설정해 주고 있다. 그러나 협소한 국토의 효율적인 이용․개발을 위하여 많은 연안 해역이 개발되고 있거나 개발 예정인 것으로 되어 있다. 특히 공유수면 매립 및 교량건설 사업 등 대규모 공익사업의 경우 사업시행지구 안의 어업인들의 어업피해뿐만 아니라 인근 주변의 어업인들에게도 많은 피해를 주고 있는 것이 현실이다. 그러나 사업시행지구 밖의 어업인들의 어업피해에 대하여 사업시행자는 매우 소극적으로 접근하고 있어 인근의 어업인들과 많은 마찰과 민원이 발생하고 있다. 이는 현행 어업의 간접손실보상에 관한 법제도가 비체계적이고 매우 추상적으로 규정하고 있기 때문인 것으로 보인다. 따라서 현행 어업의 간접손실보상에 대한 법제도상의 문제점을 검토하고 이러한 문제들이 현실에서 어떻게 표출되고 있는지 사례를 통해 살펴보고자 한다. 결론적으로 현행 어업의 간접손실보상에 대한 문제점을 검토한 후 제도적인 개선방안을 제시함으로서 사업시행자가 원활한 공익사업을 수행하고 어업인이 정당한 보상을 받을 수 있는데 기여할 수 있기를 바란다.

영문 초록

There are three seas which touch Korea and the Korean government have established fishery right in village for fishermen in order for them to make their livings by fishing, catching and picking marine products at coast and in coastal waters. However, many coastal areas are being developed and have been scheduled to be developed for the purpose of efficient use of small territory. Especially, it is true that large scale public utility projects such as reclamation of public water surface and construction of bridges are damaging neighboring fishermen as well as the fishermen in the project areas. But the undertakers of the development project are making very negative approach to damages to fishery of the neighboring fishermen, which is causing much trouble and civil appeal. It is considered that such circumstances have been resulted from regulations in connection with compensation against indirect loss or damages to fishery, which provide unsystematically and very abstractly. Thus, I intend to review points of issue of the regulations in connection with compensation against indirect loss or damages to fishery and to examine various cases how such problems are being expressed realistically. In conculsion, I intend to present a device for improvement in the compensation regime with examining points of issue in current regulations in connection with compensation against indirect loss or damages to fishery, and hope which contribute in the undertakers' progressing smoothly public utility projects and for fair compensation to fishermen.
