국문 초록

항만국통제제도는 자국의 항만에 기항한 외국적 선박에 대하여 국제법 및 국내법상의 기준에 미달하는 사항에 대하여 필요한 집행조치를 취함으로써 해상안전과 해양환경을 보호하는 통제라고 간단히 정의할 수 있다. 전통적으로 선박의 국적은 기국주의원칙을 견지해왔으며, 선박의 해상안전과 해양환경보호는 원칙적으로 기국에 의하여 적절하게 적용되고 이행되어야 하지만 기국에서 효과적인 이행을 못할 경우 보충적인 역할로써 1982년 유엔해양법협약(이하 ‘유엔해양법협약’이라 한다)은 국제법규나 기준을 준수하도록 연안국과 항만국의 역할을 인정하고 있다. 일부 국가에서 기항지국별로 항만국통제를 시행하던 것이 지역별로 협력체제를 구축하여 기준미달선 제거를 위해 노력하게 되었다. 하지만, 지역협력체제 MOU는 법적 구속력이 없어 한계성을 보이고 있으므로 조약화하는 것이 기준미달선을 제거하는 최선의 방법이 될 것이다. 지역협력체제 MOU는 현재 기본적인 조약의 형태를 갖추고 있으므로 미흡한 부분은 보충하고 명확하게 하여 조약으로 구성하여 강제화하면 항만국통제 목적을 달성할 것이고 이것이 확대되면 범세계적으로 기준미달선은 제거되고 해상안전과 해양환경보호는 달성할 수 있을 것이다.

영문 초록

Port state control can be simply defined as a control of foreign vessels in their port and territorial waters to protect the safety at sea and marine environment. Traditionally vessel's nationality adhered the principle of flag state and the vessel's safety at sea and protection of marine environment must be applied and fulfilled by the flag state but if the flag state cannot fulfill this, as a complementally role UNCLOS approved the role of coastal state and port state to comply with the international regulations and standard. Several states that carried out port state control on their own established regional cooperation scheme to effectively remove sub-standard ships. But regional cooperation scheme has no legal binding force which results in limitation of enforcement. Thus the adoption a treaty would be the best way to remove sub-standard ships. The regional cooperation scheme MOU takes a form of basic treaty, but actually does not have a binding force and is showing its limit. Therefore, the aim of port state control will be achieved in case that above mentioned insufficiently is cleared and incorporated into a binding treaty. This is the way to go towards the safety.
