해상교통법상 항법적용 시점에 관한 연구

국문 초록

해상교통법은 항해의 안전과 선박 충돌을 방지 위한 항법규정을 두고 있다. 그러나 항법규정을 언제부터 적용하여야 하는지에 관한 구체적인 규정을 두고 있지 아니 하다. 따라서 이 연구는 항법적용을 위한 고려 사항과 해상교통법의 해석론적 검토를 통하여 항법적용에 있어서 적절하고 합리적인 시점을 제시하기 위한 것이다. 항법을 적용하기 위하여서는 선박 사이에 충돌의 위험성이 존재하여야 한다. 충돌의 위험성이 없는 상태에서는 항법을 적용할 필요성이 없기 때문이다. 마주치는 상태에서 항법 적용은 야간에는 상대 선박의 마스트 등을 처음 발견한 때부터 낮에도 이 정도의 거리에서 적용하는 것이 바람직 한 것으로 본다. 앞 방향 횡단 상태에서의 항법 적용은 마스트등을 인식할 수 있을 때부터라고 본다. 옆 방향 및 뒷 방향 횡단 상태인 경우에는 현등이 보이는 거리에서부터 항법을 적용한다. 시계가 제한되지 않은 주간에도 현등의 최소 시인거리에 접근한 시점을 기준으로 하는 것이 합리적이다. 추월 관계에서는 추월선이 피추월선의 선미등을 보는 때부터 항법을 적용하는 것이 타당하다.

영문 초록

There are International Regulations for Preventing Collision at Sea, Maritime Traffic Safety Act, Open Port Order Act as the marine traffic law in our country. These Acts regulate steering and sailing rules for preventing collision at sea and the safe navigation of vessels and to ensure the safety and smooth traffic on the sea. But these laws do not regulate the commencement time or range for the application of steering and sailing rules. Therefore, this paper aims to suggest the proper and resonable commencement time for the application of these rules through the examination about the important factor to consider and the regulation of marine traffic law. For application of steering and sailing rules, risk of collision must exist between two vessels. In the case of no risk of collision, it is no more necessary to apply the rules. It is suggested that the application of the rules is able to be commenced at minimum visible ranges of the masthead light of the other vessel by night, and she observes the other vessel at same range by day in the head-on situation and crossing situation which each vessel cross her course in front of her beam. In the case of crossing situation which each vessel cross her course from a direction abaft her beam, it is at minimum visible ranges of the side light of the other vessel. In overtaking, it is at minimum visible ranges of the stern light of the vessel being overtaken.
