실버타운 입주계약에서의 고령 소비자 보호

국문 초록

고령화가 급속도로 진행되고 있는 우리나라에서 고령 소비자 문제가 사회문제로 대두되고 있다. 고령자는 사람마다 차이가 있지만 일반적으로 나이를 먹어감에 따른 심신기능의 저하로부터 판단력이나 교섭력이 감퇴하고 사회적ㆍ경제적 활동에서 점점 멀어져감으로써 지식의 진부화가 발생하는 등, 민법이 전제하는 재산관리나 거래주체로서의 인간상과 점점 동떨어져 가는 가장 약한 소비자의 모습을 가지고 있다. 또한 고령자는 노후 대책으로 모아둔 재산이 있기 때문에 악질 사업자의 타깃이 되기 쉽고 일단 발생한 피해에 대한 회복도 용이하지 않다. 이 논문은 고령 소비자의 보호가 특히 요청되는 거래, 그 가운데에서도 고령자만을 고객으로 하여 시장이 형성되어 있는 거래의 대표적 유형인 실버타운계약에 대한 법적 쟁점을 다룬 것이다. 실버타운 입주계약에 대해서는 공정거래위원회로부터 이미 2번이나 불공정계약 문제가 지적되었고, 언론을 통해 보증금 반환문제 등 고령 소비자 피해문제가 종종 보도되고 있다. 실버타운 입주계약은 다액의 비용이 들고 '종신에 걸친 개호서비스'라는 특수한 급부를 목적으로 하는 계약으로서 종래의 민법에 의한 파악이 용이하지 않은 점이 있다. 또한 한번 입주하면 옮기기도 쉽지 않아 고령 소비자가 계약에 어쩔 수 없이 강제당할 수도 있다. 따라서 고령소비자를 대상으로 하는 실버타운 계약과 같은 거래에 대해서는 고령 소비자의 보호에 대한 특별한 소비자 계약 법제의 정립이 중요하다. 특히 보증금의 반환이나 서비스에 대한 상세한 정보 제공을 비롯한 사업자의 의무를 명확하게 하고 계약의 적정화를 위한 법적 장치를 마련할 필요가 있다. 이러한 점에서 독일이나 일본이 특별법을 마련하여 계약 환경을 정비한 것은 우리에게 많은 시사점을 준다.

영문 초록

It is one of important social issues to protect the elderly consumers in Korea which experience rapid process of aging. The elderly people, generally speaking, tend to decline in discernment or bargaining power because of mental and physical changes. Their knowledge usually becomes too antiquated to deal with rapid changes of the societies. Therefore, these conditions, preventing them from thinking reasonably in contracts, made them positioned as the most weak consumers. Due to their vulnerability, they are likely to be a main target of vicious sellers who try to deceive them to seize the elderly people's retirement savings. This article discusses the legal issues about silver housing contract, which is specially needed to protect elderly consumers. The Korea Fair Trade Commission has already ordered certain facilities to correct unfair contracts. We have often heard the problems of disputes about deposit return and the violation of explanation obligation by news. A huge cost is needed to sign a silver housing contract. Because it is a complex contract intending to provide a 'care service until death', it is different from general contracts under civil law. It is not easy for elderly consumers to move their home, and they are easy to be compelled to the unfair contract. Therefore, the redesign of legal system for the protect of consumer is important in silver housing contract aimed at only elderly consumer. Especially, the regulation on unfair clauses about a penalty for breach of contract and the violation of information provide obligation are urgently called. In this viewpoint, the research about the special law of German and Japan for elderly consumer is very suggestive to us.
