국문 초록

오늘날 국제사회는 인적 물적 교류의 증대에 따라 세계화, 개방화 시대를 맞이하고 있다. 이러한 국제화의 물결은 삶의 질 향상이라는 긍정적인 효과와 함께 국제화 추세에 편승한 국제범죄의 증가는 세계화와 질서에 새로운 부담이 되고 있다. 우리나라는 그동안 국제범죄의 안전지대라 인식되었지만 급속한 경제발전과 출입국절차의 간소화 및 문호개방 등 세계화정책의 추진으로 인하여 마약, 총기, 위폐, 조직범죄 등 국제범죄의 증가와 이로 인한 피해확산위기에 직면해 있는 상황이라 할 수 있다. 현재의 국가간, 지역간, 나아가서 국제연합에서의 범죄억제를 위한 부단한 노력은 국제생활의 안정과 평화유지에 크게 기여한 것을 부인할 수는 없으나 개방화의 파동에서 기존의 대처방안으로는 크게 부족함을 실감케 한다. 따라서 국제범죄의 효율적인 억제를 위해서는 우선 국제사법공조체제가 확립될 수 있도록 다자간 협약 등이 체결되어야 한다. 특히 한국ㆍ일본ㆍ중국ㆍ러시아를 중심으로 한 동북아지역에서는 마약ㆍ위폐ㆍ조직범죄 등을 중심으로 국제범죄가 급격히 증가할 뿐 아니라 사이버범죄 같은 신종 하이테크 범죄가 출현하고 있으므로, 국가와 국민을 보호하기 위해서는 국가안보 전략차원에서 형사사법 공조법 개정 등 미비된 법률을 정비하고, 경찰ㆍ검찰에 국제문제 전담부서를 설립하는 등 관련기관의 대응체제를 강화해야 하며, 각 기관간 협력방안을 강구하고 국제교류 확대 및 인터폴을 통한 공조수사 강화 등 국제협력 체제를 강화해야 한다.

영문 초록

Recently the world is globalizing and opening its doors to other countries because of the increase in cultural and economical interchange. This wave of globalization can positively improve the quality of life, but on the other hand, it can also produce the burden of international crimes. Korea has been known as an international crime safe zone, but with its fast economical development, simplization of immigration procedures and globalization policies we are facing a break out of international crimes such as drugs, guns, counterfeiting and organized crime. We can not deny that the effort between countries, regions and the United Nations to prevent crime is stablizing people's lives and contributing to world peace greatly. However, we are aware that the existing system is not enough to cover the growth of globalization. Thus we have to reach an internationally accepted agreement between countries to achieve efficient prevention of international crime. There is a steep increase in Hi-tech crimes such as cyber crimes as well as drugs, counterfeiting and organized crime in Korea, Japan, China and Russia to protect countries and their citizens. We have to amend the imperfect laws to allow the criminals to be sent to the country. in which the crime was committied. We also have to create a agency which specializes in prosecuting international crime. International departmental and international agency cooperation should be implemented, emphasis should be placed on international cooperation by increasing international interchange and cooperation with Interpol and other police agencies.
