일본의 외국인범죄 실태와 정부대책에 관한 연구

국문 초록

본 논문은 일본의 국제화가 본격화된 1999년부터 2007년까지 일본 정부가 시행한 외국인 범죄에 대한 예방 및 검거대책을 분석하고 시사점을 검토하여, 최근 우리나라에서 문제가 되고 있는 외국인 범죄대책 수립에 유용한 정보를 제공하고자 하였다. 일본에서 외국인의 출입국은 국제교류와 부족한 인력의 충원 등 순기능측면이 있으나 돈을 벌기위하여 법정체류 기간을 넘어 불법체류하거나, 문화적 차이로부터 야기되는 범죄, 그리고 범죄를 통하여 수익을 얻으려는 역기능도 있는 것으로 나타났다. 일본의 외국인범죄에 있어서 일본방문외국인이란 일본재류외국인 중 ①정착거주외국인(특별영주자, 영주자, 영주자의 배우자등의 재류 자격자) 및 ②주둔미군관계자, ③재류자격 불명자를 제외한 외국인을 말한다. 일본방문외국인 범죄의 특징적인 동향은 흉악화, 잠재화, 확산화가 진행되는 등 여전히 어려운 정세가 계속되는 가운데, ①국민이 불안을 느끼는 흉악범이나 침입절도가 증가하고 있고, ②범행을 소수화하여, 범행의 잠재화를 도모하는 경향과, ③정규의 재류자격자(특히 "유학", "연수")의 범죄가 증가하고 있으며, ④발생 지역별로는 동경도내에서 관동, 중부 등으로 확산되고 있다. 일본에서 범죄를 저지르는 외국인 범죄조직의 범행을 살펴보면, 중국-절도와 위조범, 브라질-차량절도와 차내품절도, 한국-소매치기, 베트남-전자제품, 의약품, 화장품 절도, 필리핀-위장결혼 각성제 판매, 이란-코카인등 각성제 판매, 파키스탄-자동차절도 수출, 콜롬비아-주택절도 "Hit and Away"형 범죄, 터키인-자동판매기 물품 절도, 러시아-마약, 권총, 불법조업해산물 등을 거래하는 조직이 있다. 외국인의 불법입국이나 불법체재를 조장 하거나 일본방문외국인이 범죄를 반복해서 실시하는 것을 조장 하는 기반 이른바 "범죄인프라"는 지하은행, 위장결혼, 여권ㆍ외국인등록증명서등 각종 증명서등의 위조 및 불법취업 조장 등 일본방문외국인의 비공연ㆍ비합법 활동을 폭넓게 지원하고 있다. 이러한 일본방문외국인 범죄에 대응하기 위한 일본 정부의 조직을 살펴보면 경찰청, 법무성 입국관리국에서 외국인 범죄에 대한 정책을 수립하고, 지방정부와 지방경찰에서 지방입국관리국과 협조하여 집행하고 있다. 일본정부의 외국인 범죄대책을 예방활동과 검거활동으로 구분하면, 예방활동은 ①법규제정, ②시민홍보, ③대외국가 교섭을 들 수 있고, 검거활동은 ①합동단속대책수립 ②외국도망자 검거 ③외국기관 협조를 들 수 있다. 일본의 외국인 범죄대책으로부터 얻을 수 있는 시사점은 첫째, 세계화에 따른 ①유학, 문화교류 등 외국과의 교류와 ②노동자 산업연수생 등 인력활용을 국제화와 일본의 인구 감소에 따른 필연적 현상으로 받아들이고 있다. 둘째, 외국인의 증가에 따른 범죄의 조직화에 대비하여 일본 경찰은 ①2003년 외국인 범죄 전담부서를 신설하였고, ②2005년부터 조직범죄 정보수집 및 관리체제를 정비하였다. 셋째, 관련부처간 공동으로 대책을 추진하고 있다. 2006년 내각관방의 주제로 외국인 대책 및 외국인 월간 등을 실시하는 계획을 세우고 이를 집행하고 있다. 넷째, 글로벌화에 따른 공동생활에 대비 일본에 입국하는 외국인에 대하여 그들의 생활관습 등이 일본과 달라 벌어지는 부작용을 줄이기 위하여 ①생활개선 ②적응훈련 ③제도정비 등을 실시하고 있다. 본 연구의 제약점은 연구자의 한계로 인하여 일본정부가 발표한 자료를 중심으로 검토한 점과 각 기관별 세부내용을 모두 검토하지 못한 점, 정부대책의 대책별 세부효과를 분석하지 못한 점이다.

영문 초록

This Article, analyzing a prevention and an arrest measures of Japanese government over the foreigner's crimes from 1999 to 2007, the years when Japan carried out the internationalization in earnest, tried to review the suggestion from them and present an advantageous information for a measures over foreigners' crimes, which are recently at issue in our country. It was expressed that the foreigner's entry into and departure from Japan had a proper function such as an international exchange or a supplement of the personnel, but also had a reverse function such as an illegal stay beyond the legal stay period to earn money, the crimes originated from the cultural differences and the actions for profits through the crimes. In the foreigner's crime in Japan, the visiting foreigners into Japan mean ①settled foreigners(the resident of qualified stay including specially permanent resident, permanent resident, spouse of the permanent resident), ②persons connected to the stationary American army and ③foreigners except persons without the qualified stay of the foreigners staying in Japan. The characteristic trends of the crime from the visiting foreigners within Japan, under the difficult situation including brutalization, potentiality and proliferation, are as follows; ①The number of brutal criminals and invading thieves, who cause people much fear, are increasing. ②They reduce the number of the crimes and tend to promote the potentiality. ③The crimes originated from the foreigners with the qualified stay(especially, "students abroad" or "studying tour") are increasing. ④The places of origin are expanding from Tokyo to Kanto and the central places of Japan. Considering the crimes originated from foreigners' crime groups within Japan, there are thief and forgery from Chinese, thief of car and materials in car from Brazilian, pickpocket from Korean, thief of electronic goods, medicine and cosmetics from Vietnamese, phony marriage and sale of stimulants from Filipino, sale of cocaine including stimulants from Iranian, thief and export of cars from Pakistani, invading into houses and "hit-and-away type" from Columbian, thief of materials in vending machines from Turkey and trade of drugs, guns and illegal marine products from Russian. The named "Crime-infra", a basis to promote the illegal entry and stay of foreigners and the repeated crimes to the visiting foreigners into Japan, is broadly supporting the forgery of all kinds of certificates including underground banks, a phony marriage, a passport and a foreigner registration, and unofficialㆍillegal activities of the foreigners including an illegal employment. Considering the governmental organization in response to these crimes of the foreigners, the national police and the immigration bureau under the bureau of judicial affairs found a policy regarding the foreigners' crimes, and the local government and the local police perform it in cooperation with the local immigration bureau. Given the classification between a prevention and an arrest activity of the crime measures, the prevention consists of ①a law enactment, ②a publication towards the citizen and ③a negotiation with the other nations, and the arrest activity, ①a countermeasures establishment for cooperative regulation, ②an arrest of a fugitive criminal abroad and ③a cooperation with the foreign institute. According to the suggestion from the crime measures of foreigners within Japan, first, it is said that ①the exchange with foreign nations including a studying abroad and a cultural exchange and ②the activation of personnel including laborer's business training because of the decrease in population in Japan are the inevitable situation in Japan. Second, in response to the organization of crimes according to the increased foreigners, the Japan police ①founded the wholly responsible department of the foreigners' crimes from 2003 and ②arranged an information collection and a management system for the
