국문 초록

제17대 대통령 선거결과, 이명박정부가 새로 탄생했다. 역대 정부에서 많은 치안정책들이 대선공약으로 제시됐음에도 불구하고 결국 정책으로 자리 잡지 못하고 물거품이 되고 만 것은 무엇보다도 경찰의 독립성 확보와 밀접한 관련이 있다고 할 수 있다. 새 정부가 지금까지 결국 공약(空約)의 제시에 그친 역대정부의 전철을 밟지 않기 위해서는 경찰조직 밖의 영향력으로부터 경찰의 독립성을 지킬 수 있는 경찰시스템과 제도를 확립해야 한다. 경찰의 중립성 확보를 위한 제도개선 및 시스템화는 경찰의 독립성을 훼손하고 있는 현 경찰제도의 변화를 전제로 하며 이는 결국 현행 경찰제도의 근간이 되고 있는 경찰법의 제정을 필요로 한다. 정치적 이해득실에 따라 지난 1991년 제정되어 현재까지 경찰조직과 활동의 바탕이 되고 있는 경찰법의 태생적 한계와 여러 문제점이 경찰의 독립성을 저해하고 경찰의 제도화와 시스템화를 저해하는 중요한 요인이 되고 있기 때문이다. 따라서 본 연구는 역사적 제도주의의 관점에서 현행 경찰제도의 문제점과 한계를 집중적으로 분석, 경찰법 개정을 통한 경찰의 신제도화 필요성을 강조하는 한편 새 정부가 새로운 경찰 패러다임의 기틀에서 치안정책을 공고히 하고 궁극적으로 국민에 대한 치안서비스를 향상할 수 있도록 이론적 틀과 담론화의 장을 제공하고자 하였다.

영문 초록

The 17th Presidential election created the new government. The former governments had formulated several police policies which were not eventually implemented. Such futile polices seemed to result from the lack of independence of the police from political influences. The new government has to establish the new police system based on political independence from various influencing factors. This effort should start from the change of the present police system, particularly the revision of the police act. The police act enacted in 1991 was the result of political manipulation on the basis of political interests at that time, engendering the inherent limits and problems of the present police system. Along with a global trend, the Korean society has also experienced decentralization in almost all aspects. The pluralization and segmentation of society have accelerated decentralization and local governance especially during the last decade. The police system has been, however, one of few sectors which have not experienced such a inevitable trend as decentralization. The Korean police system has remained to be very centralized and influenced by political power, which have hindered the development of the police system. The Korean police should, thus, restructure its system on the basis of the people's trust which can be build by reconfirming the political independence of the police. The political independence of the police is the cornerstone of the new institutionalization of the Korean police system. It should be established by the revision of the present police act. Such painstaking process only paves the way for the world class police which relentlessly keep an eye on citizen's security needs. The purpose of this study is, therefore, to suggest the need for new institutionalization of the police system by the revision of the police act from the historical-institutional perspective. This study also aims to provide a theoretical framework and an arena for discourse in order to establish the new police policies based on a new police paradigm.
