국문 초록

인터넷은 세계화 과정의 한 축이며 점차 긴밀해지는 세계 속에서 과거의 현실과 익숙한 확실성 대신 새로운 기회와 도전으로 다가오고 있다. 오늘날 우리나라에서 심각한 사회적 현안으로 대두되고 있는 사이버 명예훼손, 악성댓글, 인터넷 포르노그래피 등과 같은 악의적 사이버표현행위는 현실공간에서 일어나는 언어ㆍ문자적 표현행위와는 상당히 다른 현상적 특성을 가지고 있으며 사이버공간의 급속한 확장으로 인해 만연하는 추세이다. 사회적 소외계층에 대한 차별과 폭력을 선동하고 모욕적인 언사로 자존감과 인간적 존엄성을 비하시킨다는 점에서 악의적 사이버표현행위는 반드시 근절되어야 하지만, 사이버표현행위에 대한 경찰규제는 사안 그 자체로도 논란이 많고 입장에 따라 견해가 상충하는 현안이며 악의적 사이버표현행위를 법으로 처벌하는것이 바람직한가에 대해서도 아직 완전한 사회적 합의가 이루어지지 않고 있다. 그러나 건전한 인터넷문화를 구축하는 동시에 인터넷 사용자의 기본적 권리를 보호하기 위해 적극적이고 예방적 경찰활동을 전개하는 것이 절실하게 필요한 시점이다. 인터폴 등 국제기구와의 협조적 네트워크를 구축하고, 아주 경미한 위반에 속하는 사이버표현행위는 비범죄화하여 관대한 경찰조치를 취하며, 사이버공간에 대해 예방적ㆍ적극적 경찰활동기법을 채용하는 한편 자원봉사자의 도움을 받아 사이버순찰을 강화하고, 국가유관기관끼리 사이버범죄를 예방하기 위한 합동상황실과 사이버네트워크를 구성하는 조치 등이 효율적인 사이버 경찰활동을 위해서 반드시 필요한 조치라 할 것이다.

영문 초록

The Internet is seen as part of the globalization process that is supposedly sweeping away old realities and certainties, creating new opportunities and challenges associated with living in a 'shrinking' world. In Korea, "cyber mal-expression(defamation, hate speech, internet pornography and so on)" has become serious and important social issue today. It is by no means a unique phenomenon, rather an extension of utterances both written and verbal that occur in the terrestrial world, and the expansion of the Internet has seen an unwelcome proliferation of such hate speech. The pressure to legally prohibit cyber mal-expression is founded on a perception that such utterances are actively harmful to the social inferior individuals and communities. It plays a pivotal role in inciting violence and discrimination against target populations. Patterns of abusive speech directed at them do damage to those targeted, undermining their selfhood and violating their human dignity. There is tension between surveillance and monitoring of online activities, on the one hand, and the need to protect users' privacy and confidentiality. Therefore, the imperative for police is to reinforce active police operation on cyber expression. Policing on the cyber expression is itself a controversial and divisive topic and there is no social consensus that hate speech ought indeed be made legally punishable. However, there must be possible ways for police to establish sound internet culture and to protect internet users' basic rights. For efficient cyber policing, It is helpful to found a cooperative international cyber network with Interpol. Then, it is better that most of rather minor offence of cyber expression are classified non-crime demeanors, which are treated leniently by police. To adopt tactics of proactive, preventive cyber policing, to increase cyber patrol with community volunteers, and to organize government agency network for preventing of cyber crime, I believe that all of them will be needed to do cyber policing effectively.
