국문 초록

통일과 관련하여서는 많은 논의가 있는데;법ㆍ제도적 측면과 사회학적 측면;경제적 측면과 정치적 측면 등 다양한 분야에서 통일에 관하여 논의되어 왔다. 통일과 관련하여 법ㆍ제도적인 측면에서는 통일 후 정부형태의 문제와 재산권 문제;경제질서문제 등 개별 분야마다 심도있게 연구되기도 하고 아직 연구가 미진한 분야도 있다. 통일은 남한과 북한의 체제를 통합한다는 의미이므로 사회적ㆍ경제적 통합의 필요하다. 남한과 북한이 오랜 세월 동안 각자의 방식으로 살아온 만큼 서로 차이를 보이는 분야가 많은데 이러한 문제를 해결하기 위하여 사회ㆍ경제통합은 중요한 의미를 가진다. 통일이 단순히 정치체제의 통합에 머무를 때에는 많은 비용이 들고 통일의 기반이 약할 수 있으나 사회ㆍ경제통합을 함께 이룩한다면 통일은 순조롭게 진행되고 많은 문제점이 해소될 수 있을 것이다. 사회통합을 위해서는 통일 이전에는 남북교류가 활발히 이루어져야 할 것이다. 문화ㆍ체육ㆍ예술 분야의 교류가 활발히 이루어져 서로의 문화에 대한 이해가 있어야 할 것이고 이를 통하여 통일 이후에 문화적 이질적인 요소로 인한 남북 갈등이 해소될 수 있을 것이다. 또한 법ㆍ제도적으로 사전에 정비를 하여 사회적 갈등과 대립이 생기 않도록 하여야 할 것이다. 남북의 사회통합을 위하여 법ㆍ제도적으로 정비를 하여 개정할 것은 개정하고 보충할 것은 보충하며;폐지할 것은 폐지하여 순차적으로 정비하여야 할 것이다. 또한 통일이 된 이후 사회ㆍ경제통합을 위하여 법ㆍ제도를 정비할 때 일방적으로 남한의 것을 강요할 것이 아니라 북한주민을 고려하고 우리의 법ㆍ제도 안으로 포섭하여 더불어 살아갈 수 있도록 정비하는 것이 중요하다.

영문 초록

Both South and North Korea hold common history and tradition;which is a reason the two regimes will have to accomplish there unification. It is;however;true that a 60-year national division makes both Koreas system and culture different and the resultant disparity has come to hindrance to the reconciliation between South and North Korea. There is a lot of discussion with regard unity;law and institutional aspects and sociological aspects;such as economic and political aspects have been discussed with respect to unity in a variety of fields. The South and North Korea had long been divided and the social and economic integration is necessary. The social and economic integration has very important implications. The Unification of the South and North Korea is not simply a means to consolidate the political system. The Social integration of South an North Korea is a precondition for a successful reunification of the two nations. South Korea needs to provide conditions for social integration by unifying possible social areas not only in legal systems but also the conventions of each social area of both countries. The first step to accomplish national homogeneity and the reunification is social and cultural integration;which is facilitated by human interchange and inter-Korean cooperation. Evaluating the inter-Korean social and economic interchange and cooperation;both South and North Korea had succeeded in becoming reconciled with each other;To expend and deepen inter-Korean relations in the future;the South needs to seek substantial ideas for various interchange and rearrange roles and functions of governmental and private sector.
