국문 초록

과학기술의 발달을 구가하고 있는 현대국가들은 재난과 재해가 발생될 수 있는 위험요소들로 가득 차 있다고 하겠다. 과거에는 주로 자연적 재난들로 인하여 피해가 발생하였지만;오늘날에 와서는 산업화ㆍ도시화 현상이 심화되면서 건축물ㆍ구조물ㆍ기타 시설물들이 대단지화ㆍ밀집화ㆍ고층화ㆍ심층화ㆍ복잡다양화 되고 그 구조설비와 내장재 및 수용물이 다양한 형태로 대량 존치되고 있으며 전기ㆍ가스용품 등 열기구와 화기취급시설이 날로 증가되고 차량ㆍ열차ㆍ선박ㆍ항공기 등 교통수단이 급증하고 있어 이로 인한 화재ㆍ폭발ㆍ붕괴ㆍ교통사고ㆍ환경오염사고 등 각종 인위적 재난이 증가하면서 대량의 인명피해와 재산피해를 유발하고 있다. 가까운 예로 2014년 4월 16일에 발생한 세월호 참사로 인하여 사망자 295명;실종자 9명 등 총 304명의 희생자를 내었다. 이러한 대형참사는 희생자의 고귀한 생명을 앗아가고 재산상의 막대한 피해를 초래하는 것뿐만 아니라 국론의 분열 및 국민에게 심각한 트라우마를 안겨줄 뿐만 아니라 그 치유에 있어서도 오랜 시간을 소요하게 만드는 것이다. 본 고에서는 이러한 재난에 있어서 신속하고 효율적인 대응을 위한 방안을 제시한다. 우선 법적 측면에서 「재난및안전관리기본법」에서 재난대응의 절차를 살펴보고;이에 대한 체계화 및 효율성의 제고를 위한 법적 방안으로서 첫째;재난안전관리 법제의 체계화;둘째;현장 지휘체계의 단순ㆍ명확화;셋째;재난대응 매뉴얼의 단순화;넷째;재난백서의 발간;다섯째;재난전문인력의 양성 등을 제시하였다. 재난에 대한 국가적 차원 대응에 있어서 국민들로부터 따가운 비난을 받았던 정부는 2014년 11월 19일 드디어 국가적 재난관리를 위한 총괄부서로서;강력한 재난관련 컨트롤타워 구축을 통하여 종합적이고 신속한 재난안전 대응 및 수습체계를 마련하기 위하여 국민안전처를 설립ㆍ발족하고 그 업무의 수행에 들어갔다. 국민안전처가 효율적으로 업무를 수행하는 방안에 대하여서 제시하였다.

영문 초록

It`s safely said that modern nations enjoying advanced science technology are full of risk factors that may cause disasters and calamities. In the past occurred damages mainly due to natural disasters;but nowadays;deepening industrializationㆍurbanization that make buildingsㆍstructuresㆍother facilities get larger;condensed;deep-structured;complicated and diversified with their structural facilities and interior materials massively contained within in various forms;ever increasing facilities using fire such as electricalㆍgas goods;rising man-made disasters such as fireㆍexplosionㆍcollapseㆍtraffic accidentsㆍenvironmental pollutions cause massive loss of lives and properties. For a recent example;the sinking of the Sewol Ferry on April 16th 2014 saw a total of 304 victims with 295 dead;and 9 missing. A large scale calamity like this not only deprives the victims` precious lives;but also causes a serious national schism;traumatizes people;and makes it take long to heal the trauma. This thess presents plans to rapidly and swiftly confront these disasters. First;from the legal aspect;it looks into disaster confrontation procedures contained in 「Framework Act on Disaster and Safety Management」;and then;presents first;systematization in legalizing disaster and safety management;second;simplificationㆍclarification of on-site commanding system;third;simplification of disaster confrontation manuals;fourth;publication of a disaster confrontation white paper;and fifth;training of disaster experts and etc. The government sharply criticized for its poor national disaster confrontation finally establishedㆍfounded Ministry of Public Safety & Security on November 11th 2014 and runs it as a strong disaster-related control tower that will prepare comprehensive;swift disaster confrontation and controling system. Methods for the Ministry to carry out its tasks with efficiency are also presented in this thesis.
