집회시위의 단기적 경제효과에 관한 연구

국문 초록

집회시위는 민주국가에서 헌법으로 보장하는 자유권적 기본권이다. 국가는 집회시위를 침해할 수 없으며, 아울러 제3자로부터 침해당하는 것을 보호해야 할 의무마저 갖고 있다고 할 수 있다. 그러나 집회시위의 자유는 어디까지나 합법적 수준에서 허용되는 것이며 결코 공익과 타인의 기본권을 침해하는 자유까지 허용하는 것은 아니다. 집회시위는 평화적, 비폭력적, 비무장이어야 하며, 헌법질서·타인의 권리·도덕률 등에 위배되지 않아야 한다. 안타깝게도 우리나라는 아직까지 바람직한 집회시위문화를 갖고 있지 못하다. 때문에 집회시위로 인한 사회경제적 비용이 적지않다. 이러한 관점에서 본 연구는 집회시위가 경제에 어떤 영향을 미치는 가를 실증적으로 분석하고자 했다. 분석결과, 집회시위가 경제에 미치는 단기적 효과는 미미한 것으로 나타났다. 집회시위가 기업가와 소비자들에게 약간의 부정적 경제전망을 주기는 하지만 실제 경기변동에는 거의 영향을 미치지 못했음이 밝혀졌다. 이는 집회시위로 인한 경제적 비용이 현재 우리나라 경제규모로 볼 때 경제 동향에 영향을 줄만큼 크지 않다는 것을 의미한다. 집회시위로 인한 단기적 경제효과가 발생하지 않는다는 것은 달리 표현하자면, 집회시위로 인한 비용이 우리사회가 감수해야 하는 당연한 사회적 비용이라는 것을 의미한다고도 볼 수 있다. 선진 민주국가로 가는 과도기적 상황에서 지불해야하는 통행세의 개념으로도 생각할 수 있다. 하지만 헌법과 현행 집시법이 불법 폭력 집회시위까지 허용하고 보장하는 것은 아닐 뿐만 아니라 집회시위는 반드시 공익이나 타인의 기본권과 조화를 이뤄야 하는 것이다. 때문에 불법 폭력 집회시위로 인한 손실과 비용까지 감수해야 하는 것은 아니며, 이러한 불법 폭력 집회시위로 인한 사회적 손실과 비용을 줄일 때 경제성장에 긍정적 영향을 줄 수 있다고 본다.

영문 초록

The right of assembly and demonstration is a fundamental right protected by the constitution in a democratic country. The government should not infringe the right of assembly and demonstration and furthermore should protect it from being violated by the third one. The right of assembly and demonstration may be protected only if it is enjoyed legally, otherwise it should not be permitted. Assembly and demonstration should be peaceful, nonviolent, and should not violate other citizens' rights and ethical code. Unfortunately a desirable culture of assembly and demonstration has not been developed yet, which causes enormous social costs. Therefore, this study attempts to analyze the short-term effects of assembly and demonstration upon the economy in South Korea. The result of this study shows that the effect might be minimal and neglectable. Although assembly and demonstration offers negative economic prospect to entrepreneurs and consumers, it doesn't affect actual business fluctuation. Such a result suggests that economic costs of assembly and demonstration are not a problem for the Korean economy which is the 12th largest in the world. The fact that the economic effects of assembly and demonstration are neglectable implies that the costs of assembly and demonstration is the social cost which our society should pay. It might be considered as a tax to pay for the process of entering into a developed country.
