깨어진 창문이론적 관점의 경찰 아웃리치서비스의 한계에 관한 연구

국문 초록

깨어진 창문이론에서는 지역사회의 범죄예방과 시민의 범죄두려움을 줄이기 위해서 경찰이 보다 지역주민과 밀착된 법집행과 범죄억제, 그리고 서비스를 제공하는 것을 기본적인 과제로 인식한다. 따라서 이 이론은 1970년대 이후 지역주민의 참여로 지역의 범죄문제를 해결할 수 있다는 명제를 다양한 사례를 통하여 검증함으로써 미국경찰을 비롯한 각국의 경찰정책의 변화를 가져왔다는 점은 높이 평가받아야할 것이다. 깨어진 창문이론적 측면에서는 범죄예방의 적극적인 방법으로 지역경찰의 차량순찰 보다는 도보순찰방법을 권장한다. 또한 지역주민의 범죄두려움을 억제하기 위하여 아웃리치서비스의 도입을 적극적으로 활용한다. 그러나 이와 같이 지역사회 경찰활동이라는 전략으로 시행한 다양한 아웃리치 서비스는 오늘날 그 문제점이 드러나고 있다. 즉, 지역주민을 경찰지지세력과 무관심세력으로 이원화하거나, 경찰력 보강을 위한 시민자원봉사자나 보조경찰활동 범주에 대한 불명확한 한계와 모호한 책임성, 지역사회 문제해결이라는 명분하에 개인의 사생활을 이웃주민들의 감시하에 두고 있는 점 등이 대표적인 것이다. 그러나 무엇보다 가장 큰 문제점은 사소한 일탈이 반드시 심각한 범죄로 발전할 것이라는 확신을 가지고 경찰활동을 한다는 점이다. 이 연구는 깨어진 창문이론적 관점에서의 아웃리치서비스에 대한 경찰의 인식을 바탕으로 향후 한국 경찰이 바람직한 지역사회 경찰활동을 수행하기 위하여 다음과 같이 제안한다. 첫째, 지역사회 경찰활동의 한계를 반영한 방범전략이 모색되어야한다. 둘째, 시민자원봉사자의 활동범위와 그 책임범위 등은 법적인 근거를 두어야 한다. 그리고 이들에게 적당한 장구를 제공하며 안전을 보장하여야한다. 셋째, 경찰은 경찰목적달성에 충실하여야 하며, 복지적 서비스는 일반행정기관 또는 시민사회에서 행해질 수 있도록 한다. 즉 그 전문성과 효율성을 고려하여야 하며, 경찰은 단지 지원자로서의 역할에 머물러야 할 것이다. 넷째, 이웃간감시전략 등 지역주민의 생활에 대한 지나친 경찰의 개입을 지양하고, 지역주민과의 의사소통을 위한 도보순찰의 확대와 다양한 통로를 열어야한다. 다섯째, 지역사회 경찰활동을 위한 새로운 부서설치 및 경찰내근인력 확보 등은 지양한다. 이는 경찰내근부서의 비대화를 가져오며, 경찰의 관료주의화 또는 준군사주의화를 심화시키기 때문이다.

영문 초록

Based on the broken window theory, police's basic tasks are law enforcement and crime prevention and providing services, for community crime prevention and deterrent citizen's fear of crime. Since 1970, broken window theory have set a high value on changing many countries' policing policies by examining a hypothesis that community can solve the problems about crime of their district. To be familiar for community police to citizen, it's better a foot patrol than a car patrol. And out reach service should introduce to deterrent citizen's fear of crime. However, there are some problems in out reach service as a part of community policing. Like as, community separate two part-police support and police apathy-. And rights and responsibilities about the activity of citizen volunteers and police auxiliary are indefinite. Also, to solve the community problems, watching citizens is rather a problem. However the Worst problem is people thinking that a trivial deviation makes progress a serious crime. Based on the notion of police about the out reach service from the broken window theory, this study presents five ways to reform measures which are listed below. First, we should find a strategy of crime prevention based on community policing problems. Second, it's necessary to be the legal framework about the rights and responsibilities on the activity of citizen volunteers and police auxiliary. Also the security of citizen volunteers and police auxiliary is protected. Third, the police must be faithful to police goal attainment. Welfare service must take charge of the general administrative organization or community. And the police should perform just as supporter for them. Fourth, the life of community citizen should not be meddled with by the force of police like as neighborhood watching service. Between police and community citizen should need communication. For this, it's necessary to increase a foot patrol. Fifth, we should refrain from setting up the new unit of police and enforcement police personnel of an internally oriented post for community policing. Because these will lead to results of strengthens a bureaucracy or a quasi military organization.
