국문 초록

이 연구에서는 깨진 창 경찰활동에 대한 이론적 배경 등을 고찰하고 테일러가 제시한 협력활동 모형과 범죄통제 모형을 토대로 기초질서위반사범에 대한 접근 방안을 제시했다. 일반적으로 경찰실무에서 말하는 기초질서위반사범이란 「경범죄처벌법」등에 규정된 경미한 범죄나 질서위반행위 또는 그 경미한 범죄나 질서위반행위를 저지른 자를 의미한다. 테일러는 깨진 창 경찰활동의 개념적 근거를 반문화행위 테제(incivilities thesis)에서 찾고 있으며, 반문화행위 테제를 근거로 깨진 창 경찰활동을 지역사회에 기반을 둔 협력활동 모형과 무관용 경찰활동으로 대표되는 범죄통제 모형으로 구분하고 있다. 협력활동 모형은 범죄에 대한 두려움의 감소, 이웃관계의 안정, 그리고 범죄로부터의 안전을 도모하기 위해서 경찰과 주민들이 함께 반문화행위를 감소시키는 활동을 전개함으로써 깨진 창 경찰활동을 수행하는 것으로 요약된다. 범죄통제 모형은 범죄행위에 대한 억제를 가장 중요한 기능으로 보는 형사사법적인 모형이다. 범죄통제 모형에서는 법집행의 효율성을 중시하기 때문에 특히 신속하고 엄격한 법집행이 강조된다.

영문 초록

This study describes the approaches to the minor infractions focused on the broken window policing with R. B. Taylor' s models, or "coproduction model" and "crime control model". Also he conceptualizes broken window policing with inactivities thesis. In korean police practice, Minor infractions generally means offenses like smoking in restrict areas, crank calls, public urination, aggressive panhandling and so on, which they are prescribed in the Minor Infractions Punishment Law. In United states, Broken windows policing refers to a police emphasis on disorderly behavior and minor offenses, often referred to as "quality of life" offenses like prostitution, public urination, and aggressive panhandling. R. B. Taylor used two approaches to describe broken windows policing. Coproduction model means that producing public safety is a coproduction process, wherein police and citizens, and other organizations working with the police all contribute to the outcomes, or reduction of fear of crimes, stability of neighborhood relations, safety from crimes. Crime control model means the criminal justice system model that views the repression of criminal conduct as its most important function. This model emphasizes efficiency and lays stress on speed and finality.
