국문 초록

현재 세계의 위기는 크고 깊다. 위기를 어떻게 타개할 것인가는 방법에 대한 질문이자 목적에 대한 질문이다. 철학과 가치에 대한 질문 없이 목적지를 정할 수 없다. 결국 현재 위기에 대한 질문은 철학과 가치에 대한 질문이다. 자유민주공화국에서 자유는 기본가치다. 자유의 이름으로 진보와 보수의 갈등이 심화되고 있다. 따라서 자유가 무엇인지 모두에게 물어야 할 필요가 있다. 자유의 본질이 무엇인지에 대한 답을 J.S Mill의 <자유론(On Liberty)>에서 찾고자 한다. 밀의 사상은 고전적인 자유주의 및 공리주의를 근간으로 하고 있다. 밀의 개인은 자유인인 동시에 자기 주권자이고, 자기 주권자인 동시에 자유인이다. 이성이 보장될 때 자유가 가장 잘 발휘되고 진리에 더 가까이 갈 수 있다. 자유없는 이성은 죽은 이성이며, 자유 없이 진리의 발견도 사회 발전도 없다. 따라서 가장 자유로울 때 공리는 자연스럽게 충족된다. 멋대로의 자유를 본질로 하고 있는 밀의 자유론도 자신의 생명이나 타인의 생명을 침해할 수 없다. 또한 자기 자신의 자유를 포기할 권리도 없다. 이런 자유에 대한 본질적인 제한은 공리로도 침해할 수 없다. 따라서 밀의 자유론은 공리주의에 선행한다. 밀은 자기주권논리를 통해 자유에 대한 보호 논리와 규제논리를 끌어내고, 자유주의 논리 속에 공리주의를 적절하게 소화해내고 있다. 이성에 근거한 자유는 자연스럽게 가치다원주의로 연결됨으로써 근대적 관용 논리를 제공하고 있다. 각자가 자유롭게 선택한 가치들은 자신이 선택하지 않은 일에 대한 책임을 면제한다. 자신이 선택하지 않은 민주적 결정에 따를 의무도 없다. 따라서 밀의 자유론은 민주주의와 연결되지 않는다. 그리고 밀의 자유론은 자유의 촉진을 허락하지 않으며, 오직 자유의 속박을 거부하는 소극적 자유론이다.

영문 초록

Today's world crisis is deep and big. How to resolve this crisis is a question of method and purpose. Without questioning philosophy and value, purpose cannot be determined. Thus, the question about today's crisis is a question about philosophy and value. Libertyis basic value of free democratic republic. Conflict between conservatives and progressives has aggravated under the name of liberty. Therefore, there is a strong necessity to question everyone about what liberty is. This study would like to navigate through J.S. Mill's , which provides classical answer, to contemplate the conundrum. Mill's ideology lies on classical liberalism and utilitarianism. Therefore, not only liberalism's philosophical basis self-sovereignty and rationality but also utilitarianism constitutes the foundation of Mill's . Mill's individual is a freeman regarded as a self-governor, and a self-governor regarded as a freeman. Only when there is rationality, can liberty be emanated and truth be disclosed. Rationality without liberty is lifeless, and neither truth nor social progress can be observed. Thus, utility is most gratified when liberty is at its full stance. Mill's liberty, liberty as an indulgence, however, cannot violate one or another's life. Also, Mill does not allow right to abandon one's own liberty. These basic constraints on liberty cannot be violated by utility. In other words, Mill's liberty precedes utilitarianism. Mill provides self-sovereignty as a rationale for the protection of liberty and constraints. Moreover, he effectively digests the principles of utilitarianism into liberalism. Liberty based on rationality naturally connects with value-pluralism and thus displays modern discourse of toleration. Liberty to select values grant exemption from responsibilityon unselected conducts. There exists no duty to follow democratic decisions that one did not choose. Thus, Mill's libertarianism disconnects with democracy. Furthermore, Mill does not intend to expand liberty, but only remain as a passive libertarianism, which resists against restraints on liberty.
