수산업법의 처벌 규정에 관한 연구

국문 초록

수산업법이 제정된 이후 처벌은 계속 강화되어 왔고 처벌 항목도 증가되어 왔으나, 처벌 내용에 대한 연구는 거의 없었다. 본 논문에서는 수산업법의 처벌 규정을 분석하여 처벌의 정도는 적절한지, 이중으로 처벌하는 규정은 없는 지 등에 대하여 검토하였다. 이러한 검토를 토대로 수산업법의 처벌 규정에 대한 문제점을 도출한 후 그에 대한 개선 방안을 다음과 같이 제시하였다.첫째, 행정형벌에 대한 규정에 대해서는 거짓이나 그 밖의 방법으로 면허나 허가 받은 자에 대한 처벌 강화, 제61조의 어업조정 등에 관한 명령을 위반한 자에 대한 규정, 어업허가의 타인지배에 관한 처벌 규정 등의 개정이 필요하다. 둘째, 행정질서벌에 대한 규정에 대해서는 과태료의 조정, 행정형벌과 과태료의 이중부과 문제 해소, 신고에 대한 처벌규정 및 감경ㆍ가중 사유 등에 대한 개정이 필요하다. 셋째, 과징금에 대한 규정에 대해서는 부과기준의 강화, 감경기준의 명확화 등에 대한 개정이 필요하다. 넷째, 과태료에 대한 규정에 대해서는 통고처분제도의 도입, 가중ㆍ경감 규정 등에 대한 개정이 필요하다.

영문 초록

Although after the revision of the Fisheries Act, the penalty had been enforced with increased number of offenses defined, there had been almost no studies carried out in regards to suitability of penalty provision. In this study, the penalty provision of the Fisheries Act was analyzed and the suitability of weighing of penalties, whether there are any cases that punish trivial offenses were investigated. Based on the investigation performed, problems in regarding penalty provisions of the Fisheries Act were identified and the plans of reformation are here forth proposed. Firstly, in regards to the provision on penalties, the following was proposed - enforce penalties for those who acquired licenses or approvals through deception or other unlawful deeds, revise the law for those who violated the clause 61, which is the order made for adjustment on the fishery and the revision on the law about penalty for misusing other people' fishery license. Secondly, in terms of penalties regarding administrative order, it was pointed that the amount of the fine should be increased, resolve double imposing of administrative penalty and the fine and revise the provision on the consent for reporting. Thirdly, in terms of provision on fines, increase in infringement criteria and the clarification on reduction criteria were proposed. Fourthly, in the terms of provision on surcharge, introduction of notification system and revision on enforcement or reduction of penalty were proposed.
