연안국의 예방적 관할권에 관한 연구

국문 초록

국제환경법의 원칙으로서의 예방의 원칙은 육상기인 해양오염으로 인한 해양환경보호, 기후변화, 야생동물보호, 대기오염 분야 등 다양한 분야에서 적용되어 왔다. 예방의 원칙에 대한 가장 통상적인 정의는 리우선언 제15조에서 찾아볼 수 있다. 해양환경보호와 관련하여 UN해양법협약과 IMO 해사협약에서 예방의 원칙을 통하여 기국과 연안국간 힘의 균형을 설정하고 있다. 특별민감해역, 항로지정제도, 대량살상무기확산방지구상, 선박관제제도 등과 같은 제도를 연안국이 외국선박에 대하여 자국의 권한을 강화하기 위하여 자의적 차원의 예방적 조치로 활용하고 있다. 이 논문의 목적은 해양환경에 위협을 주는 외국선박에 대하여 연안국의 권한을 강화함에 있어서 예방의 원칙이 할 수 있는 역할을 결정하는데 있다. 특히 이 논문에서는 연안국이 자국의 인접해역에서 외국선박과 관련한 연안국 관할권에 대하여 예방의 원칙이 어느 정도의 영향을 미칠 것인가를 심도 있게 검토한다.

영문 초록

The precautionary principle as part of international environmental law has received applications in various fields, such as marine protection law from land-based source pollution, climate change, wildlife protection, and atmospheric pollution. The most commonly accepted definition of the precautionary principle is found in Principle 15 of the Rio Declaration of the 1992 United Nations Conference on Environment and Development. In relation to the marine environmental protection, UNCLOS and IMO maritime conventions establish the balance of powers between flag states and coastal states through the this precautionary principle. Legal tools such as Particularly Sensitive Sea'Areas, Ships' Routing Measures, Proliferation Security Initiative and Vessel Traffic Services can be seen as precautionary measures at the disposal of coastal states to strengthen their powers toward foreign ships. The objective of this paper is to determine the role that the precautionary principle could have in extending the powers of coastal states in relation to ships posing a threat to the environment of their marine and coastal areas. In particular, this paper is to examine the current extent of the influence of the precautionary principle on coastal states' jurisdiction with respect to foreign vessels in their adjacent waters.
