영문 초록

This paper examines how the rights of registered trademark are restricted in the perspective of the unfair competition prevention law when famous or well-known mark and registered one exist concurrently. Even though a mark has been registered in accordance with the trademark law, in the case that it is 'famour or well-known mark' of a third party defined by the unfair competition prevention law, there could be conflicting legal issues. To find out the appropriate way of solve such problems, this paper study the relevant cases and the relationship between trademark law and unfair competion law.
