잡지 기사에 나타난 인격권 침해 특성에 관한 연구

국문 초록

그동안 언론에 의한 인격권 침해 관련 연구들이 구체적인 데이터 분석 없이 추상적인 논의나 사례연구에 그쳐 왔다. 이에 최근에 데이터 분석을 시도하는 연구들이 일부 진행되고 있지만 잡지에 대한 연구는 전무하다. 인격권 침해는 언론의 신뢰와 관련되어 있으므로 더 좋은 언론이 되기 위해 반드시 성찰해야 할 문제다. 그러나 현황 파악이 제대로 되지 않은 상황에서 올바른 성찰을 하기 어렵다. 이에 본 연구에서는 잡지의 인격권 침해 현황을 파악하기 위해 2005년부터 2012년 8월까지 신청된 언론조정 사건 총 146건을 전수 분석하였다. 분석은 통계프로그램 PASW 18.0을 이용하여 신청인 유형별, 청구 유형별, 침해 유형별, 처리결과별로 이루어졌다. 분석 결과, 신청인 유형에서는 개인이, 청구 유형에서는 정정보도청구가, 침해 유형에서는 명예훼손이, 처리결과에서는 합의가 가장 많은 것으로 나타났다. 본 연구는 향후 연구와 논의의 기초자료를 제공하기 위해 전반적인 경향을 파악하는 데 초점을 맞추었다. 향후에 잡지에 의한 인격권 침해의 연구들이 더 활성화되어 보다 심층적인 분석들이 이뤄지길 기대한다.

영문 초록

Personal rights related studies in the media were usually focused on the case studies or abstract discussions without the concrete data analysis so far. These days several studies on the data analysis conducted were noticed, but there are nothing shown in the media studies related on personal rights violations seen in the magazines. Topic on the personal rights violations is really important in that the media have to maintain its trust in order to have time to reflect on itself. For this purpose, we researched the current data on personal rights violation shown in magazines. In order to meet this purpose, we examined the data on the press conciliation from January, 2005 to August, 2012. In total, all 146 cases were analyzed by subscriber type, claim type, violation type, and process result type with the statistical program PASW 18.0. Results showed that individuals accounted for large part in subscriber type. As for the claim type, report corrections were occupied mainly. As for the violation type, defamation were apparent. As for the process result type, mutual agreements were dominant. This study contributes to give the basic data on further related studies with the data analysis. Finally, the limitations of the current study, and suggestions and implications for future studies were discussed.
