현행 「국가대테러활동지침」에 대한 비판적 검토

국문 초록

국제스포츠행사는 인류 번영과 평화를 기원하는 화합의 장(場)으로써 그 의미가 크다고 할 수 있다. 그러나 이러한 국제스포츠행사의 의미가 국제테러리즘에 의해 퇴색되는 경우가 자주 발생하고 있다. 그 대표적인 사례로는 1972년 제10회 뮌헨올림픽대회에서 팔레스타인 테러조직 검은9월단(Black September)에 의해 이스라엘 선수단이 피살된 사건이 있다. 한국도 1988년 서울올림픽대회 개최를 앞두고 국제테러리즘과 북한 국가지원 테러리즘에 대응하기 위하여 1982년 1월 22일 대통령훈령 제47호 「국가대테러활동지침」을 제정ㆍ시행하였다. 그러나 행정규칙인 동 지침으로 국가와 국민의 안전과 직결되는 대(對)테러리즘 행정을 규율하는 것은 법치주의 요구에 배치된다. 또한 동 지침은 그 내용이 불명확하여 유추ㆍ확대 해석할 가능성이 있고, 테러리즘 발생에 대한 예측가능성과 법적안정성이 미흡하다. 그리고 대통령훈령 제47호 「국가대테러활동지침」은 '테러리즘' 정의에 대량살상무기(WMD)를 이용한 생화학테러리즘(Biochemical Terrorism)을 명시적으로 규정하지 않고 있어 법(法)논리의 일관성에 한계가 있고, 또한 국무총리가 테러대책회의 의장이 됨으로써 대(對)테러 관련 군병력(軍兵力)과 장비(裝備)를 테러리즘 발생지역으로 신속하고 체계적으로 이동시키지 못하는 문제도 있다. 이에 이 연구에서는 행정규칙인 대통령훈령 제47호의 한계를 극복하기 위하여 (가칭) 「테러방지법」의 제정을 제안하고자 한다. 만약 (가칭) 「테러방지법」의 제정에 어려움이 있다면, 동 지침의 내용에 생화학테러리즘에 대한 부분을 명기(明記)하고, 테러대책회의 의장을 국군통수권자인 대통령으로 변경하며, 대테러 활동을 3단계에서 4단계로 세분화하는 등의 개선책을 모색하는 것이 바람직하다고 본다.

영문 초록

International sports events have a special meaning to pray for the prosperity and peace of humankinds. However, these days these international sports events get interrupted frequently by international terrorism. Famous example is the incident that Israeli players were killed by Black September in the 10th Olympic Games in Munich in 1972. On the occasion of Seoul Olympics in 1988, Korea enacted and enforced 「Guidelines for National Counter-terrorism Activities」to respond against international terrorism and government supported terrorism by North Korea on January 22 in 1982 as Presidential Directive No. 47. However these administrative guidelines do not meet expectations as they are counter-terrorism administration based on legalism principle and do provide predictability and legal stability. Additionally, as Presidential Directive No. 47 「Guidelines for National Counter-terrorism Activities」don't explicitly refer to the biochemical terrorism using weapon of mass destruction, there are limitations in consistency of legal logic. Furthermore, as Prime Minister chairs Counter Terrorism Committee, it is difficult to move military force and equipment to terrorism event occurring place fast and systematically. To resolve such difficulties and overcome limitations of Presidential Directive No. 47 「Guidelines for National Counter-terrorism Activities」as an administrative regulation, it is proposed to enact so called 「Anti-Terrorism Act (tentative name) 」. If there are difficulties in enacting 「Anti-Terrorism Act」we may add biochemical terrorism to these existing guidelines, change the chair of Counter Terrorism Committee to President who is the supreme commander of the armed forces, and improve counter-terrorism activities from the three steps to 4 steps by breaking down the stages.
