헌법재판소가 바라 본 소비자의 권리

국문 초록

현대의 소비자는 인터넷을 통하여 자신이 살고 있는 지역과 국가에 관계없이 상품 정보를 확인하고 구매하는 방식으로 급격히 소비패턴이 변화되고 있다. 이것은 상품을 직접 보고 선택하지 못한다는 점에서 소비자의 선택권이 침해될 위험성이 높아졌다는 것을 의미한다. 본 논문은 이러한 현실 변화에 대하여 우리의 헌법은 소비자의 권리를 어떻게 보장하고 있으며, 헌법재판소는 어떻게 해석하고 있는가에 대하여 검토하였다. 소비자의 권리에 대한 종래 학계의 논의사항을 분석하여 기본권으로서 소비자의 권리가 의미를 갖는지 살펴보고, 소비자의 권리가 갖는 헌법상의 위치와 근거를 헌법 제124조의 해석을 통해서 검토하였다. 그동안 헌법재판소의 소비자의 권리에 대한 결정례를 분석하고, 최근 헌법재판소에서 내린 주요 결정사례를 통해 앞으로의 경향을 살펴보았다. 소비자의 권리는 소비자기본법을 통하여 소비자의 권익을 증진하고 피해구제를 위한 제도적 장치를 마련하는 등 구체화되어 가도 있으나, 소비자 문제가 국민의 생활에 미치는 영향에 비하여 헌법적인 연구는 부족하다. 종래 학계의 논의는 소비자의 권리가 헌법상의 기본권인지, 기본권이라면 그 근거를 어디에서 찾아야 하는지, 헌법 제124조는 소비자보호운동만을 보호하는 것인지 여부 등에 대하여 나누어져 있다. 최근 헌법재판소는 소비자불매운동 사건을 통하여 소비자의 권리와 관련하여 의미있는 내용을 결정하였다. 소비자의 권리를 헌법 제124조에 의하여 보장되는 기본권으로 판단하는 해석을 보였다. 비록 그 표현의 불완전성에도 불구하고 헌법재판소의 결정은 바람직하다. 앞으로 헌법재판소는 소비자기본권에 대한 보다 적극적이고 명확한 입장을 내놓아야 할 것이다. 소비자의 권리는 우리 헌법에서 기본권편이 아닌 경제편에 위치하고, 명시적 표현이 없다는 문제에도 불구하고 기본권으로 인정되어야 하고, 그 근거는 헌법 제124조에서 찾아야 한다. 기본권편에서 규정되어 있지는 않지만 헌법의 이념인 기본권의 최대한 보장이란 점에서 헌법내 조문의 위치는 문제가 안 되며, 소비자보호운동은 소비자의 권리를 전제로 하기 때문에 소비자보호운동을 보장하는 규정은 당연히 헌법상의 소비자기본권을 의미한다.

영문 초록

Modern consumer checks online product information through internet irrespective of region and country he lives in and then, purchases the product so that his consumption patterns rapidly change. This means higher risk of consumers' selections owing to the fact that a consumer cannot directly see and select a product. This thesis reviews how our constitution guarantees consumers' rights in this connection and how the Constitutional Court interprets such change in reality. They have materialized consumers' rights by providing an institutional strategy to improve consumers' rights and to relieve their damage through the Framework Act on Consumers but constitutional research is not sufficient comparing to influence which consumer problems have over people's living. Existing discussions in academic world vary in whether or not consumers' rights are fundamental rights under the constitution and if so, where we can find its ground; and, whether or not the article 124 of the constitution protects consumer protection movement only. Recently, the Constitutional Court made a meaningful decision regarding consumers' rights through a consumer boycott case. They made an interpretation to consider consumers' rights as fundamental rights guaranteed by the article 124 of the constitution. In spite of incompleteness of the expressions, the decision by the Constitutional Court is desirable. It is required for the Constitutional Court to suggest more positive and clear-cut position on consumers' rights in the future. Consumers' rights have to be placed in economy volume instead of fundamental rights volume of the Korean constitution, and consumers' rights have to be recognized as fundamental rights despite lack of specific expressions, of which ground has to be found from the article 124 of the constitution. The location of provisions in the constitution does not matter from the point of maximum guarantee of fundamental rights being constitutional ideology even though they are not provided in fundamental rights volume, and provisions to guarantee consumer protection movement naturally mean fundamental rights under the constitution because consumer protection movement is subject to consumers' rights.
