대리운전의 법적 문제와 입법의 필요성

국문 초록

경찰의 음주운전 단속 강화로 유흥가를 중심으로 소규모로 시작된 대리운전 영업행위가 2002년부터 대리운전 이용의 대중화ㆍ대리운전업체가 조직화ㆍ대형화되고 있다. 2012년 10월 국민권익위원회와 대리운전 업계의 따르면, 전국의 대리운전 업체 7,000여개가 활동하고 있는 것으로 추산하며, 대리운전업체에서 대리운전자로 일하는 사람도 8만-12만 명으로 보고 있다. 전국적으로 1일 대리운전 요청 전화는 약 40만 건으로 추정되고 그 수요는 계속증가하고 있다. 대리운전 시장규모는 연간 약 3조원으로 추정하고 있으며, 국토교통부가 음주단속 기준을 0.05%에서 0.03%로 낮추는 것을 추진하고 있는 바, 대리운전의 수요는 더욱 더 증가할 것으로 판단된다. 대리운전업이 자유업으로 분류되어 사업자 등록만 하면 운영가능 한현행제도는 대리운전업체의 난립과 횡포로 이어져 대리운전 이용자의 불만 등 각종 민원이 발생하고 있다. 또한, 대리운전업은 정부나 지방자치단체의 관리나 규제밖에 있으며, 대리운전 업체수ㆍ대리운전종사자 수도 정확히 파악하지 못하고 있는 실정이다. 무보험 대리운전, 음주 이용자를 대상한 범죄, 대리업자의 대리운전자 에로의 비용부담 전가 등 각종 불만과 법적 분쟁 증가 추세이다. 대리운전에 대한 공론화과정을 거쳐 대리운전에 관한 입법이 추진되어야 한다고 판단된다. 대리운전법의 법제화 내용에는 대리운전자 자격요건 강화, 대리운전 사업자 및 대리운전자 보험가입 의무화, 대리운전업의 등록제 도입과 협회 설립 근거 마련, 대리운전 표준약관 제정 및 요금 신고 명문화, 대리운전업 관리 감독 강화 규정 등이 포함되어야 한다고 판단된다.

영문 초록
