국문 초록

미국은 수많은 유형의 지역권들을 인정하고 있다. 이에 비하여 우리는 요역지에 부종하는 지역권만을 인정하고 있다. 이와 같이 지역권에 대한 개념의 차이도 있지만, 지역권 수용에 따른 법적인 문제와 토지의 가치평가에 있어서도 양국은 서로 차이가 있다. 따라서 수용기관이 사인의 지역권을 수용할 경우에 미국은 요역지를 기준으로 토지의 가치를 평가하고 있지만, 우리는 승역지를 기준으로 토지의 가치를 평가하고 있는 것으로 보이기 때문에 이를 비교법적으로 검토하고 있다. 이와 관련하여 소유권 외의 권리의 목적이 되고 있는 토지의 보상평가에 있어서 소유권 외의 권리에 대한 가치평가가 원시취득한 수용부동산의 가치평가보다 더 클 경우에 이에 대한 보상문제를 어떻게 해결할 수 있는지에 대해 살펴보고 있으며, 이러한 문제점을 해결하기 위해 미국은 어떠한 새로운 평가방법을 제시하고 있는지도 알아보고 있다. 더욱이 수용기관이 공익사업을 위해 사인의 토지를 사용할 경우에 우리와 미국은 보상평가기준과 방식에도 서로 차이가 있다. 중요한 것은 사인의 토지를 사용함으로써 발생하는 사용 토지 자체에 대한 가치하락과 잔여지의 가치하락에 대한 보상이 인정될 수 있는지 여부가 문제이기 때문에 이를 우리와 비교분석하고자 하는 것이다. 특히 우리는 송전선ㆍ송전탑의 설치와 관련하여 ‘밀양송전탑 사건’이 사회적으로 큰 이슈가 되고 있기 때문에, 이에 대한 문제를 어느 정도 해결하기 위해 우리의 토지보상법의 보상규정의 문제점을 검토하면서, 이에 대한 방안을 제시하고자 한다.

영문 초록

The United States has been recognized numerous types of easements. Easements in the laws of the United States are as follows: aqueduct easements; avigation (air space) easements; beach front easements; building height/view easements and negative covenants; cable television easements; canal easements; clearance easements; conservation easements; flowage easements; light and air easements; mass transit/street railway easements; overflow rights easements; pipeline easements; power transmission line easement; private street easements; scenic easements; slope easements; temporary easements; and all manner of utility easements. But Korea law only ‘Easements Appurtenant’ has been recognized. Korea is increasing the damage of the residents caused by the installation of transmission lines and pylon. Miryang pylon incident was a big social issue. Judicial issues need to be carefully checked in order to solve these problems. Thus, This paper will investigate the concept of easement and condemnation of easement, as well as Korea Law by comparing, the laws of the United States will investigate how to compensate the damage caused to the acceptance of an easement. The condemnation of easements by public agencies and privately owned public utilities presents a series of special legal and appraisal problems for the property owners. It is important to understand the nature of easements and the differences between the acquiring agencies(the condemnors) in the easement area. This paper will explore some of the problems and possible solutions when easements are condemned and created for the benefit of the condemnor and also when pre-existing, privately held easements are condemned or interfered with by the condemning authority. Issues unique to easements valuation will be considered trial issues that are impacted in this process. This discussion will cover some of the various phases involved in the taking of an easement from the point of view of the landowner.
