영문 초록

The recent development and spread of smart device, intellectualized technology, and social service led to the advent of smart era. Smart Era can be defined as a time when information customized to individuals is supplied by internet rapidly and accurately, using products attached with high-tech intelligence. The higher possibility of infringement of personal information by various technologies and media also increased the necessity of personal information protection. Based on this understanding, this study explored the possibility of applying the right to be forgotten as a remedy for damage caused by old news articles on the net. Studying the significance, contents, effect, restriction of the right to be forgotten, it reveals that it has a general type of the elimination claim and the search block claim as an active right. In Korea, many press released various articles about the right to be forgotten and people got to have new interest on it. Furthermore, some opinions suggested new legislation for the right to be forgotten. So, this paper examined whether we need new legislation to adopt the right to be forgotten or not.
