일본의 테러대책 현황과 한국의 과제

국문 초록

본 연구는 한국과 대내외적으로 비슷한 상황 하에서 테러대응 정책을 강구하고 있는 일본의 테러정세와 테러대책 현황을 살펴보면서 우리에게 주는 그 함의는 무엇인지 살펴보고자 하는데 그 목적이 있다. 일본의 테러대응 대책을 통해 앞으로 한국이 지향해야 할 방향을 제시하면 다음과 같다. 첫째, 실질적인 테러발생 시에만 편성ㆍ운용되는 비상설기구라는 점 때문에 법제적 기반의 구축이 미흡하여 구속력을 발휘할 수 없는 시스템을 갖추고 있기 때문에 비상설기구가 아닌 24시간 체제를 갖춘 상설기구로 재편성되어야 하며 그러기 위해서는 무엇보다 현행의 훈령을 상위법으로 전환해야 할 것이다. 둘째, 항공기 공중납치 방지대책과 관련하여 탑승명단을 기장에게 제출하는 규정은 마련되어 있지 않고 항공기 내에 무장항공보안요원도 전무한 실정이다. 따라서 자들은 테러 예방의 경각심을 인식하여 무장항공보안요원의 도입도 적극적으로 고려해야 할 것이다. 셋째, 국가중요시설의 경우 특수경비원과 청원경찰이 국가중요시설에 배치되어 경계경비 업무를 전담하고 있기 때문에 테러대응 관계기관의 관계자들은 이들과의 긴밀한 상호협력체제를 갖추어 정보 수집 능력을 강화할 필요가 있다. 한편, 철도와 지하철의 경우 철도특별사법경찰대와 지하철수사대가 담당하고 있지만 그 수와 장비는 여전히 부족한 실정이기에 정부 차원에서 이들에 대한 인적ㆍ물적 지원을 고려해야 할 것이다. 넷째, ‘자생 테러리스트’가 새로운 경향으로 대두되고 있는 상황에서 자칫 다민족ㆍ다문화의 폐단이 자국인들의 극단적인 반감이 자극되어 테러사건으로 몰고 올 수 있는 여지를 충분히 제공할 수 있기에 이에 대한 고민도 필요할 것이다.

영문 초록

This study aims at grasping implications to us from overviews on Japanese status of, and countermeasures against, terror, for the country takes a step to display policies against terror, domestic as well as foreign, similar to Korea. On the model of Japanese countermeasure against terror, Korean directions are suggested as followings. First, the organization is established and operated on the occurrence of terror and can not display binding force due to poor legal foundation. Standing organization has to be established in order to stand for 24 hours. First of all, instructions have to be replaced into higher regulation. Second, no regulation is established in connection with submitting passenger names to captains as a countermeasure against hijacking of air flights. No armed air flight worker is prepared. The regulation has to describe the content concretely. On the other hand, airline business persons have to recognize the importance of terror prevention and consider on introducing armed air flight workers positively. Third, special guards and private polices are placed at national important facilities ,and they execute alert and guard affairs. So, those in connection with terror-response organizations have to prepare for mutual cooperation with them and enhance the ability to collect information. On the other hand, railroad police and subway investigation agency take charge of the affairs for railroad and subway, but personnels and devices are insufficient. The government has to consider on personnel, material assistance. Fourth, in the situation that 'self-generated terrorists' comes to the force as a new tendency, the negative multi-racial, multi-cultural effect may stir national extreme hostility, so this point has to be considered on sufficiently.
