성폭력 수사에 있어 이차피해 과정: 남성 경찰관을 중심으로

국문 초록

본 연구는 남성 경찰관의 성폭력 편견과 피해자에 대한 태도(비난과 의심), 수사과정의 어려움(증거부족, 동기부족), 이차피해유발 수사행동(저항ㆍ동의, 정황, 피해자 특성)의 정도에 대해서 알아보고 이러한 변인들이 성폭력사건수사과정에서 발생할 수 있는 이차피해 유발 수사행동에 영향을 미치는 요인을 조사하고자 하였다. 이를 위해 경남지역에서 성폭력수사 경험이 있는 남성경찰관 182명을 대상으로 빈도분석과 구조방정식 모형검증을 실시하였다. 빈도분석 결과, 남성경찰관의 성폭력에 대한 편견과 의심은 비교적 낮은 편이었으나, 피해자 비난태도는 상대적으로 높았다. 성폭력 수사의 어려움은 동기부족보다는 증거부족으로 인한 어려움이 높은 것으로 나타났다. 이차피해유발 수사행동 중에서는 정황이나 피해자특성 보다는 저항ㆍ동의를 중시하는 정도가 더 높게 나타났다. 구조방정식 모형검증 결과, 성폭력에 대한 편견은 피해자에 대한 비난과 의심을 증가시키는 것으로 나타났다. 피해자에 대한 비난이 증가될수록 저항ㆍ동의를 중시하는 수사행동이 증가되며, 의심이 증가될수록 동기부족으로 인한 어려움과, 정황을 중시하는 수사행동이 증가되는 것으로 나타났다. 한편, 동기부족으로 인한 수사의 어려움이 클수록 증거부족으로 인한 수사의 어려움과 정황을 중시하는 수사행동이 증가되는 반면, 증거부족으로 인한 어려움이 클수록 저항ㆍ동의를 중시하는 수사행동이 증가되었다. 저항ㆍ동의를 중시하는 수사행동이 증가될수록, 정황을 중시하는 수사행동은 증가한 반면, 피해자 특성을 중시하는 수사행동은 감소하는 것으로 나타났다. 정황을 중시하는 수사행동이 증가될수록, 피해자 특성을 중시하는 수사행동도 증가되는 것으로 나타났다. 연구결과를 토대로, 이차피해에 대한 경찰의 의식향상 캠페인, 경찰의 의식전환 및 전문화를 위한 교육, 이차피해 자가진단 사정도구의 개발 및 자가사정 체계구축, 성폭력 관련 법 개정, 여성친화적 환경 조성이 제안되었다.

영문 초록

This study aims to explore the secondary victimization process in police investigation of the sexually assaulted victims. For this purpose, a hypothetical model which explains the relationships among 3 attitudinal variables(prejudice against sexual assault, victim-blaming attitude, doubt on the victim's report), 2 investigation difficulty variables(difficulty due to lack of motive, and due to lack of evidence), and 3 investigative behaviors causing the secondary victimization(IBSV), by taking account of the importance of extra-evidences in the investigation process(victim's consent/or resistance, situational factors, and victim characteristics) was developed. Using the data collected from 182 male police officers in 3 cities in Gyeongnam, who had investigated the sexual violence crime, the model was tested by a structural equation modeling. The results of frequency analysis showed: ①Prejudice against sexual assault and doubt on victim's report were low, but victim-blaming attitude was relatively high. ②Difficulty due to lack of evidence was higher than difficulty due to lack of motive. ③Among IBSV, the IBSV of victim's consent/or resistance was higher than those of situational factors and victim characteristics. As a result of structural equation modeling, the followings were found: ① Prejudice against sexual assault increased victim-blaming and doubt on the victim's report; ② Victim-blaming increased IBSV of victim's consent/or resistance; ③Doubt on the victim's report increased the difficulty due to lack of motive, and IBSV of situational factors; ④ Difficulty due to lack of motive increased difficulty due to lack of evidence; ⑤Difficulty due to lack of motive increased IBSV of situational factors, while difficulty due to lack of evidence increased IBSV of victim's consent/or resistance; ⑥ IBSV of victim's consent/or resistance increased IBSV of situational factors, while decreased IBSV of the victim characteristics; ⑦ IBSV of situational factors increased IBSV of victim characteristics. Based on the findings, ① consciousness raising campaign to reduce the secondary victimization among the police officers, ② educational program for the police officers, ③ development of the measurement for self-assessment of police officers' investigative behaviors as well as establishment of self-assessing system in police, ④ legistration reform to increase the protection and support for the sexually assaulted victims, and ⑤ social construction of the female-friendly environments were suggested as a way to prevent the secondary victimization in the police investigation as well as to protect the human right of the sexually assaulted victims.
