서울특별시 특별사법경찰제의 실태 분석과 개선방안에 관한 연구

국문 초록

1956년 처음으로 우리나라에서 특별사법경찰제도가 시행되었다. 이 제도가 발전을 거듭하여 2012년 8월 현재 각부처별로 46개 종류의 특별사법경찰제가 운영 중이다. 본 논문에서는 서울특별시 특별사법경찰제에 관한 연구를 진행하였는데 이는 2008년 1월 1일 우리나라 광역자치단체 중에서 처음으로 창설되어 2012년 6월 현재 만 4년 5개월의 역사를 가지고 있다. 그 당시 서울특별시의 행정국 산하에 특별사법경찰과가 발족되고 그 아래에 수사총괄팀, 중앙수사팀, 동부수사팀, 서부수사팀, 남부수사팀, 북부수사팀 등 6개의 수사팀을 만들어 범죄적발을 본격화했다. 현재 서울특별시 특별사법경찰의 전체 인원은 총 116명이다. 이들의 핵심 직무분야는 식품ㆍ원산지 표시ㆍ공중위생ㆍ의약ㆍ환경ㆍ청소년보호ㆍ개발제한구역보호 등 7개 분야이다. 그러나 서울특별사법경찰과는 금융ㆍ상거래 분야, 자동차관리 분야, 축ㆍ수산물위생처리분야, 체육시설설치이용 분야, 건축관련 분야 등 5개의 업무영역을 2012년 현재 업무의 영역을 넓혀 나가고 있다. 서울특별사법경찰과 수사팀원들은 2008년 5월부터 2012년 5월까지 3,955건의 범죄를 입건하고 검찰에 3,516건을 송치하여 기소율 92.1%를 보여주는 큰 효과를 거두었다. 이처럼 서울특별시 특별사법경찰제가 많은 발전을 가져왔음에도 불구하고 아직까지 극소수의 연구보고서 1-2편만 소개 되었을 뿐 서울특별시 특별사법경찰제만을 전적으로 다룬 전문 학술논문은 발표된 적이 없다. 본 논문은 미래에 특별사법경찰 관련 학술연구가 본격화될 때 그 기초연구토대를 제공하기 위한 목적을 두고 수행되었으며, 특히 본 연구에서는 서울특별시 특별사법경찰과를 대상으로 특별사법경찰권 부여 관련 제도적 취지, 원칙, 직무범위, 현실적인 수사권 행사 및 서울시 관할 영역에서 특별사법경찰에게 적발된 각종 범죄의 업무처리실적, 재교육 등에 대한 직무와 문제점을 분석한 후 제도적 차원의 발전 방안을 제시하였다.

영문 초록

The special judicial police system was enforced for the first time in our country in 1956. As this system repeated the advancement, 46 kinds of special judicial police systems are now operating for each governmental department. This essay carried out a study on the special judicial police system of Seoul Metropolitan Government. Seoul Special Judicial Police System was established on January 1, 2008 for the first time among our metropolitan municipalities in our country and it keeps a history of 4 years and 5 months as of June 2012. During the time, Special Judiciary Police Division under the Administration Bureau of Seoul Metropolitan Government was launched to mainly address the criminal investigation as 6 investigation teams were organized, including Overall Investigation Management Team, Central Investigation Team, Eastern Investigation Team, Western Investigation Team, Southern Investigation Team and Northern Investigation Team. Currently, the total personnel of Seoul Special Judicial Policy include 116 persons in total. Their core functional areas cover 7 areas including the food, marking of origin, public sanitation, medicine, environment, juvenile protection and protection of limited development areas. However, Seoul Special Judicial Police Division is widening its service areas as of 2012, including 5 service areas such as the financial and commercial area, automobile management area, livestock and marine product sanitation processing area, the area for the use of athletic facility installation, and the construction areas. Investigation team members of Seoul Special Judicial Policy Division have achieved great effects as they have accused 3,955 cases of crimes from May 2008 to May 2012, sent 3,516 cases to Prosecution Service, and showed 92.1% of the prosecution ratio. Although the special judiciary police system of Seoul Metropolitan government has shown a great deal of developments as such, an extremely minor number of study reports with 1-2 editions have been introduced up to now, but there have been few academic essays or presentations. This essay was carried out to provide the basic study foundations when the academic studies are carried out in earnest with regard to the special judicial police in the future. Especially, this study suggests the institutional intents, principles, job functional areas, exercise of actual investigation rights with regard to the grant of the special judiciary police rights for Seoul Special Judiciary Police Division, as well as plans for the development in terms of the institutional level after analyzing the job functions and problems for the work processing achievements and re-training among others for various crimes which have been detected by the special judiciary police in the area which Seoul Metropolitan Government is governing.
