국문 초록

본 연구는 공천제도와 입법생산성이 개별 국회의원의 유인체계와 정당 내부 의사결정을 매개로 어떻게 연결되는지를 이론적•실증적으로 분석하고 있다. 하향식 공천제에서는 공천권을 행사하는 자가 정당 내부의 모든 의사결정을 행사하는 구조가 형성된다. 이러한 의사결정구조에서는 다양한 의견이 존재하기 힘들고 편향된 의견이 당론이 될 가능성이 높다. 따라서 국회에서 정당 간 의견조정이나 타협이 어렵게 되어 입법생산성이 저하된다. 반면, 상향식 공천제에서는 정당의 의사결정구조가 민주화됨에 따라 정당 간 의견수렴이 훨씬 용이하게 되어 입법생산성이 높아진다. 본 연구에서는 1948년부터 2009년까지의 연간 입법 통계와 상향식 공천제도가 부분적으로 시행되었던 17대 국회의 의원별 법률안 발의 및 통과 자료를 근거로 실증분석을 실시하였다. 그 결과 상향식 공천으로 선출된 의원들이 높은 입법 생산성을 나타내고 있음을 입증하였다. 이런 맥락에서 정당 민주화라는 규범적 측면에서뿐만 아니라 개별 국회의원들의 경쟁 제고 및 정당 간 갈등 완화를 위해 상향식 공천제의 전면적인 도입이 필요함을 시사한다.

영문 초록

This study analyzes the impact of a legislative candidate selection process on legislative productivity theoretically and empirically. The candidate selection process and legislative productivity are linked through lawmakers’ incentive structure and within-party decision-making. In this context, two types of candidate selection processes, top-down and bottom-up, are contrasted and they hold the following theoretical implications. In a top-down process, party’s decision making is centralized to one who rules candidate selection. Such a centralized decision making structure creates bullheaded extreme party lines to both ruling party and opposition parties. On the other hand, in a bottom-up process, party’s decision making process is decentralized and a party finds it hard to take headstrong party lines due to various opinions reflecting different constituencies. Hence it would be much easier for parties to compromise or coordinate conflicting views, leading to a higher legislative productivity. Based on all the annual legislation data from 1948 to 2009 and 17th National Assembly Members’ legislative activity data, our paper reports that those theoretical conjectures are empirically supported. In this context, the bottom-up candidate selection process should be implemented in Korea on a full scale for enhancing legislative productivity as well as democratization of political parties.
