홍콩의 외국인노동자 고용관리체계

국문 초록

홍콩자치정부의 외국인노동자 도입정책을 역사적 변천과정, 정책실행을 위한 행정조직, 정책의 핵심인 고용허가제도의 운영과 외국인 취업관리, 그리고 불가피하게 발생하는 불법체류자 대책을 중심으로 검토하고 있다. 홍콩은 외국인력도입을 제도화하는 독자적 법률이 없이, 경영합리화 및 산업구조 조정에 대체하는 경제 정책의 일환으로 융통성 있게 적용하고 있다. 홍콩의 외국인력제도는 가정부 수입 프로그램, 보충노동력 수입계획, 중국과 기타 외국의 전문기술자 도입프로그램으로 나뉜다. 가정부 수입 프로그램은 홍콩 여성의 경제활동참가율을 높이기 위해 지속적으로 추진해온 반면, 보충인력 수입계획의 경우 홍콩인의 취업을 절대 우선으로 하는 원칙 하에 극히 제한적 인력수입을 허용하고 있다. 중국과 외국의 전문 기술자 도입프로그램은 지식산업의 기반확충으로 통해 지속적인 경제성장을 위해 홍콩이 중점을 두고 있는 프로그램이기도 하다. 홍콩에서 외국인노동자는, 출입국 및 체류를 위한 일부 조례를 제외한 나머지 부분에서 홍콩인과 법적으로 동등한 대우를 받도록 되어 있다. 이를 통해 내국인 취업 기회 침식이나 외국인 인권침해의 소지를 제거하는 한편, 지속적인 불법체류자 단속과 계도를 통해 불법체류자 규모를 통제하는 데 성공하고 있다. 홍콩의 외국인노동자 관리체계는 최근까지도 수많은 불법체류 외국인 노동자와 그들의 인권침해로 문제가 되고 있는 한국의 외국인력 정책에 시사하는 바가 크다

영문 초록

The paper is a review of international labour migration management by the government of the Hong Kong Special Administrative Region (Hong Kong SAR). Specifically, its discussion focuses on the government administrative structure for migration management, the main labor migration schemes, its history and current procedures, and the policies and practices on irregular migration including labor inspection. Hong Kong SAR manages international labor migration through various administrative rules, and not through specific legislation set up exclusively for foreign migrant workers. Migrant workers are given equal rights in almost every aspects of domestic laws with an exception of those regulating their entry and departure. There are four labor migration schemes bringing in foreign domestic helpers (FDHs), workers for lower skilled jobs where local workers are not found (through Supplementary Labor Schemes), and much needed highly skilled professional workers from mainland China and the rest of the world. Based on the principle of recruitment of local workers, Hong Kong SAR tightly controls a labor shortage job list under which lower-skilled migrant workers are invited, while it has continued to expand the importation of FDHs in order to promote the labor participation of local women. Furthermore, Hong Kong SAR is actively seeking highly-skilled professional workers from mainland China and the rest of the world in order to further its economic growth and structural improvement. Hong Kong SAR merits a close examination as the government successfully manages to supply needed labor force while upholding the human rights of the foreign workers through labor inspection, and while being able to exert sustained efforts to reduce the irregular overstay of foreign workers to a minimum.
