해적행위의 실태 및 초국가적 공조방안

국문 초록

오늘날 전 세계 국제무역거래 유동량의 90% 이상이 해상운송에 의존하고 있고, 우리나라도 수출입 화물량의 99%를 해상운송에 의존하고 있다. 그런데 세계 경제의 중추적인 유통경로를 담당하고 있는 해상운송을 위협하는 해적활동이 한 해에 약300-400건 정도 발생하고 있으며, 우리 선원과 선박이 해적에 납치되어 억류되는 사건도 자주 발생하고 있다. 해적사건은 과거에는 주로 말라카 해협을 비롯한 동남아시아와 인도 주변에서 많이 발생하였지만, 2007년경부터는 소말리아 인근 해협과 아덴만 외에 홍해 남부, 예멘, 오만, 아라비아해, 케냐, 탄자니아, 세이셸, 마다가스카르, 인도양원해 등까지 활동범위가 확대되고 실정이다. 해적들의 공격유형도 인질, 위협, 폭행, 상해, 살해, 납치 등으로 구분이 되고 있으며, 공격에 사용되는 무기들도 개인화기에 해당하는 소총에서부터 각종의 중화기에 이르기까지 위험한 무기들이 다양하게 사용되고 있다. 세계 굴지에서 활약하고 있는 해적들에 대한 국제기구와 개별 국가들의 대응에도 불구하고, 해적들의 불법행위와 피해사례는 예전처럼 늘어나는 경향이 나타나고 있다. 이에 해적행위의 심각성을 반영하듯 국제사회에서는 각종의 해적퇴치와 대응 그리고 공조를 위한 협약들이 체결되어 있다. 대표적으로 UN해양법협약(UNCLOS), 항해의 안전에 대한 불법행위의 억제를 위한 협약(SUA협약), 국제해사국(IMB), UN의 인질억류방지에 관한 국제협약, 아시아 지역 해적행위 및 선박에 대한 무장강도 행위 퇴치에 대한 지역협력협정(ReCAAP), 국제해사기구(IMO)에서의 협정들이 국제적인 협력체계를 요구하고 있다. 해적행위에 의한 피해발생현황, 해적들의 지역별·유형별 공격·피랍유형과 한국 선박의 피해사례 등 전반적인 피해상황은 심각한 상황에 이르고 있으며, 아울러 국제사회의 적극적인 공조방안이 요구되고 있는 만큼 국내적·국제적 협력방안으로 선박 보호를 위한 법·제도적 대응과 무장보안요원(PCASP)의 승선 의무화를 위한 입법 및 정책, 해적에 의한 피랍선박의 경보전파 체제 확립 그리고 해적퇴치를 위한 국제기구와의 사전적·사후적 연계협력은 반드시 필요하다.

영문 초록

International trade world today, more than 90% of the amount of flow is dependent on maritime transport. Also, Korea's import and export cargo volume to 99% is dependent on maritime transport. But the backbone of the global economy is responsible for distribution channels and piracy in the maritime transport activities that threaten the cases 300 to 400 occur in approximately one year, and Korean sailor and ship hijacked by pirates is also frequently the case that has been detained. Pirate attacks in the past, mainly in Southeast Asia and India, including the Straits of Malacca were significantly more frequent in the vicinity. However, by 2007 in addition to the Gulf of Aden and Red Sea, Strait From the southern Somalia, Yemen, Oman, Arabian Sea, Kenya, Tanzania, Seychellois, Madagascar, Indian Ocean range of activities is expanding. Types of attacks by pirates have a hostage, threaten, assault, injury, murder, kidnapping have been distinguished. Weapons used to attack some individuals from the various rifles for firearms ranging from heavy weapons have been used for many of these dangerous weapons. International organizations and individual countries is the response for pirates in the world's leading. Nevertheless, illegal acts of piracy and the damage cases as the former tend to increase is accelerating. Reflecting the seriousness of piracy in the international community and the response of various anti-piracy, and they signed a cooperation agreement. Representative to the UN Convention on the Law of the Sea (UNCLOS), SUA Convention, IMB, UN International Convention on the Prevention of the Taking of Hostages, ReCAAP, IMO Convention on the system they are calling for international cooperation. South Korea, including the ship's overall damage cases the damage has reached a critical situation and active cooperation of the international community there is a need to plan. First, laws and institutional response for the protection of marine, Second, the armed security personnel foresees mandatory legislation and policies of the board, Third, the pirates seized the ship's alarm radio system, Fourth, anti-piracy cooperation with international organizations linked reactive dictionary is necessary.
