예산법률주의와 지방정부 예산전쟁

국문 초록

우리나라는 국가와 지방자치단체의 예산결정을 너무도 위험하게 치킨게임의 상황으로 방치하고 있다. 권력분립의 대통령제는 국민 또는 주민의 예산의지를 행정부(대통령 또는 자치단체장)와 의회(국회 또는 지방의회)의 상호작용 속에서 결정한다. 의회가 내각을 불신임하고 행정부가 의회를 해산하는 내각책임제와 달리, 대통령제는 행정부의 장과 의회 의원들에게 각각의 임기를 안정적으로 보장하기 때문이다. 이러한 대통령제 하에서는 두 가지 제도적 요소가 동시에 구비되면 치킨게임의 상황이 나타나는데, 이들 요소는 ‘예산 비법률 주의’와 ‘의회의 지출예산 증액제한’이다. 예산결정에 대한 이 두 가지 제도적 요소는 행정부와 의회의 갈등을 증폭시켜 많은 사회적 비용을 초래하는 파국으로 끌 수 있다. 의회는 행정부가 심혈을 기울이는 정책사업의 예산을 얼마든지 일방적으로 삭감 확정할 수 있고, 행정부는 의회가 요구하는 예산증액 및 신규사업을 고집스럽게 거부할 수 있다. 증액과 감액을 양분하여 의회와 행정부가 벌이는 대립과 충돌의 게임은 어느 한 쪽이 양보하지 않으면 양쪽 모두 파국으로 치닫는 치킨게임의 상황과 같다. 2010년 6월 이후 서울시장과 여소야대의 서울시의회가 무상급식을 놓고 벌였던 그 기나긴 예산전쟁은 예산결정에 대한 이러한 제도적 결함 때문이기도 하다. 서울시 무상급식의 예산전쟁 그리고 이에 따른 소모적 사회적 갈등을 피하기 위해, 이제 우리는 예산제도의 결함이 무엇인지 반드시 그 교훈을 찾아내야 한다.

영문 초록

The budgetary decisions of the central and local governments in Korea are handled very dangerously like the game of chicken. The presidential system with division of power must make decisions for the sake of citizens and residents by interaction between the President and the heads of the local governments of the administrative branch and the National Assembly and local assemblies of the legislative branch. This is because, unlike the parliamentary cabinet system with the nonconfidence in the cabinet by the parliament and the dissolution of the parliament by the adminstration branch, the presidential system stably guarantees each of the terms of the head of the administrative branch and the members of the legislative branch. Under this presidential system, the situation of the game of chicken arises when the two constitutional factors in making budgetary decisions occur simultaneously, budget regarded as non-legal administrative regulations procedures and a restriction on the increase of budgetary expenditures by the assembly simultaneously occur. These two factors of budgetary decisions can increase the level of conflict between the administrative branch and the assembly which can lead to the end of much societal expenses being incurred. The assembly can unilaterally reduce the budget of the policies that the administrative branch has devoted itself to at any time and the administrative branch can obstinately rebuff the demands of budget increases and new programs of the assembly. The opposition and collision between the assembly and the administrative branch of being divided on budgetary decisions is similar to the situation of the game of chicken where both will experience catastrophe if one side does not yield. The lengthy budgetary war between the mayor of Seoul and the Seoul city assembly with an opposition majority since June, 2010 over the free school meals is due to this type of flaw in the budgetary decision system. In order to avoid the budget war of the city of Seoul and the exhaustive societal conflict that follows it, the lessons regarding the flaw in our budgetary system must now certainly be discovered.
