대만의 지적도중측사업 고찰

국문 초록

우리나라 지적제도의 법⋅제도 및 정책적 차원에서, 외국사례로서 유용하게 인용 혹은 참고되었던 대상국가 중 하나는 바로 대만이다. 특히, 지적재조사사업과 관련하여 사업추진 방법, 특별법 이하의 하위법령 제정, 지적측량정확도 규정 개선방향 모색 등의 다양한 측면에서 대만의 사례가 연구되어왔다. 그러나 국내의 서적 및 연구물에서는 대부분 1980년대, 1990년대 인용된 자료들이 재인용되는 사례가 최근에까지 빈번하였고, 2011년 들어 몇몇 국내연구보고서를 통해 대만의 지적도중측사업과 관련한 근거법 및 관계법령, 그리고 사업의 방법론 및 추진성과 등이 부분적으로 소개되어지고 있다. 이에 본 연구에서는 대만의 내정부 홈페이지자료, 대만학자들의 연구논문, 그리고 지적도중측사업과 관련한 근거법으로서 토지법 과 관계법령으로서 지적측량실시규칙 , 수치법지적도중측실시수책 등의 자료를 참고하여 지적도중측사업에 대하여 고찰하였다. 연구범위로서는 연혁적․현재적 관점으로 대분하여 지적측량, 법령, 사업계획 및 추진성과 등 3개 측면을 중심으로 고찰하였다. 본 연구는 대만의 지적제도와 지적재조사사업(지적도중측사업)에 관한 대만의 현지 자료를 중심으로 고찰하였다는 점에서 국내 연구자 및 정부담당자들에게 중요한 자료를 제공한 연구논문으로서 의의가 있다.

영문 초록

Taiwan was one of the countries the government of South Korea generously employed as an example and reference of overseas precedents in establishing the nation's laws, institutions, and policies governing the nation-wide cadastral system. Preparing for its own cadastral map projects, South Korea studied the cases of Taiwan in various aspects including project approaches, legislations other than Special Acts, defining tasks of improving the accuracy of cadastral maps, etc. Unfortunately, most South Korean books and other researches tended to cite materials that had been already cited during the 1980s and 1990s until very recently. Only a few researches introduced some of the base laws and other legislations involving cadastral map projects, the methodology and outcomes of the cadastral map projects, and so on. Accordingly, this study aims to look into cadastral map resurvey projects referring to materials including data available from the government of the Republic of China's official web sites, research papers submitted by Taiwanese scholars, legal materials such as the base law related to cadastral map projects, and other relevant legislations such as the Land Laws, the Cadastral Map Acts, the General Guidelines of Cadastral Map Project Acts, and so on. The scope of this study involves three categories: cadastral map survey, related legislations, and cadastral map projects and their outcomes from historical and contemporary perspectives. The significance of this study mainly lies in the fact that this could become an important source of information for South Korean researchers and government officials in the related field in that it looks directly into the local data on the cadastral map systems and cadastral map resurvey projects.
