국문 초록

여성장애인은 생물학적, 사회적 특성으로 인해 남성장애인과 비장애여성에 비해 특별한 욕구를 가지고 있을 뿐만 아니라 사회적 약자로서의 지위를 점하고 있다. 따라서 이들에 대한 차별의 문제는 장애인차별금지법 뿐만 아니라 다양한 관련법과의 관계 속에서 조명될 필요가 있다. 이에 본 연구는 여성장애인의 특수성에 초점을 맞추어 장애인차별금지법과 상충되는 법령을 분석하고 가능한 범위 내에서 입법대안을 제시하는 것을 목적으로 진행되었다. 이를 위해 설정한 분석기준은 여성장애인에 대한 직접적 차별을 금지하고 있는 장애인차별금지법 제33조(장애여성에 대한 차별금지)와 제34조(장애여성에 대한 차별금지를 위한 국가 및 지방자치단체의 의무), 장애인의 모ㆍ부성권 보호를 위해 규정하고 있는 제28조 및 제29조였다. 검토대상 법령은 현행 정부조직법상 17개 정부부처의 소관법령 전체를 대상으로 하였는데 일차적으로 여성장애인과 전혀 내용적관련성이 없는 일부법령은 제외한 후, 여성장애인을 기준으로 장애인차별금지법 조항들과 상충되거나 여성장애인 차별이 발생할 가능성이 높은 법령 107개를 선별하여 이들을 대상으로 분석기준을 활용하여 분석하였다. 그 결과, 장애인차별금지법과 상충되는 법령 조항들은 모성, 고용 및 소득보장, 건강권, 폭력피해보호, 법제도 등 5개의 주제로 대분류할 수 있었다. 각 주제별로법 간 상충되는 핵심내용과 상충사유를 검토한 후 조항 개정이나 삭제, 신설 관련 대안을 제시하였다.

영문 초록

Women with disability are considered as having specific and unique needs of their own due to the biological and social characteristics, comparing with the men with disability as well as women in general. Women with disability in our society are one of the most deprived group because discrimination against them are prevalent. Therefore the discriminative phenomenon should be examined in relation to the existing legislations with reference to the Disability Discrimination Act. This study examined extensive amount of legislations which are in contradiction to the Disability Discrimination Act focusing on the issues of women with disability and made new resolution for the better practice of the existing legislations not to discriminate women with disability. The analysis criteria lies on the articles of 33, 34 and 28, 29 of the Disability Discrimination Act. 107 legislations are selected and thoroughly examined which are in direct or indirect relation to the discrimination of women with disability. In conclusion, 5 categories have been found and analysed with alternative articles which are motherhood, employment and income security, health rights, support for the violence victims, and judicial procedures.
