활동보조서비스에 대한 장애인의 인권문제와 이에 대한 대책방안에 관한 연구

국문 초록

이 연구는 활동보조서비스에 관련된 장애인들의 인권 문제와 이에 대한 대책방안을 모색하였다. 우리나라는 2000년의 동경국제교류제단과 일본 Human Care협회의 후원으로 전국주요도시를 순회하며 개최된 한국장애인자립생활세미나를 통하여 전국적인 홍보와 자립생활의 이념보급과 중증장애인의 새로운 지원모델 가능성을 제시하고, 이 세미나를 기점으로 우리나라에 자립생활이 소개되고 이해당사자인 장애인 및 복지관 등에 퍼지며 사회적 이슈로 등장하며 10년도 못 미치는 짧은 시간동안 장애인의 이동권 쟁취, 지역별 자립생활센터의 설치, 활동보조서비스의 제도화 및 전국적인 실시 등의 결과물을 산출해냈다. 그러나 시범사업에 대한 평가와 문제점에 대한 대비책이 충분히 마련되지 않은 채본 사업이 실시되면서 모든 장애인들이 서비스를 받을 수 있는 권리가 있음에도 불구하고 활동보조서비스가 활발하게 일어나고 있지 않다. 따라서 이에 대한 대책방안은 모든 장애인들이 활동보조서비스를 이용할 수 있는 대상제한 폐지, 생활시간 보장, 자부담 폐지 등 공동투쟁단의 3대 요구 중 가구소득기준과 무관하게 제공할 것과 18세 미만에도 동일한 서비스를 제공해야 할 것이다.

영문 초록

This study investigated human-right issues of the disabled related to PAS (Personal Assistance Service) and sought for relevant measures. With the support of Tokyo International Exchange Foundation and Human Care Association in Japan in 2000, the Korea self-supporting life seminar for the disabled has been established by making a tour all over main cities in Korea. Through the seminar, the idea of self-supporting life was distributed, and the possibility of new support models was suggested for the severly disabled in addition to its national-wide promotion. Based on this seminar, self-supporting life was introduced into Korea, and since then, it has appeared as a social issue as its concepts are spread to the interested parties, such as the disabled and community welfare centers. In a short time less than 10 years, the seminar has contributed to achieving such outcomes as winning a mobility right for the disabled, establishing a self-supporting life center in each region, institutionalizing PAS and its national-wide execution. However, since this project was conducted without providing an evaluation on a pilot project and preparations for possible problems, PAS hasn’t been really activated, although all the disabled have a right to receive the service. As countermeasures, therefore, it is required to provide the disabled with the service regardless of their household incomes and even provide those below 18 with the same service, out of the three requests of the joint-protesting group, such as abolition of target restrictions, guarantee of life time and abolition of self-pay.
