법치주의의 현대적 변화와 투명성에 대한 헌법적 고찰

국문 초록

현대사회의 급속한 변화와 더불어 헌법의 영역에서도 새로운 논의가 필요한 문제들이 많이 출현하고 있다. 그 중에서도 법치주의와 관련해서는 우선, 정당정치의 발달로 입법권과 행정권이 통합되는 현상이 지속적으로 발생하고 사회국가이념의 실현과 경제적 위기에 대한 극복이 강조되면서 행정부의 권한이 상대적으로 커지는 등 행정권에 권력이 집중되면서 고전적인 권력분립을 통치기구의 조직원리로서 그대로 적용하는 것의 타당성이 의심을 받고 있다. 또한 과학기술의 발전 속도가 빠르고 국내외적인 환경이 시시각각 변화하는 상황에서 법이 사회적 변화에 적극적이고 신속하게 대응해야 할 필요성이 커짐에 따라 행정입법이 증대하는 등 법적 안정성에 부정적인 영향을 미치는 요소들이 많아지고 있으며, 이밖에도 법에 복잡하게 분화하면서 빠르게 발전하는 기술이 반영되고, 고도로 전문화되고 세분화되는 사회의 각 영역을 규율할 필요성이 커지면서 법적 명확성에 대한 요청도 후퇴될 가능성을 보여주고 있다. 오늘날 국가기관의 권한행사에 대한 국민의 통제와 관련된 논의를 비롯하여 행정권의 행사에 관한 많은 법령에서 투명성이 중요하게 언급되고 있는바, 투명성은 정보사회에서 추구되어야 할 매우 중요한 가치로 평가될 수 있다. 법치주의 역시 그 시작이 폐쇄적인 행정권에 대한 불신에 기초하고 있다는 점에서 이러한 투명성의 이념을 내재하고 있다고 할 수 있으며, 법치주의의 본질적 요소라고 할 수 있는 권력분립과 법률유보, 법적 안정성과 신뢰보호, 명확성의 원칙에도 투명성의 이념이 함축되어 있다. 법치주의는 역사적 발전과정에서 시대상황에 대응하며 의미를 확정해왔다. 투명성은 법치주의의 구현에 핵심적 기능을 한다고 할 수 있는바, 법치주의가 현대사회에 적합한 헌법원리가 될 수 있도록 그 실현방안을 구체적으로 모색하는 과정에서는 투명성의 이념이 충분히 고려되어야 할 것이다.

영문 초록

With the rapid changes of modern society in the area of constitutional issues that require a lot of new debate is emerging. Likewise, with regards to the principle of rule of law new problems are raising and the rule of law is at risk. First, the development of party politics, legislative and executive powers are consistently integrated. As the realization of the welfare state and overcome of the economic crisis are emphasized, the administration’s authority has been growing relatively. So, the power is concentrated in the executive power, and the classic principle of separation of powers as the governing organization has been questioned it's validity. Next, with fast development of science technology and constant changing international situation, the law is need to respond actively and quickly to this social environment. According to the increasing of the administrative legislation, legal factors that influence the stability of the negative is getting a lot. Finally, complex and rapidly evolving technology is reflected in the law and the law should regulate the highly specialized and segmented society, to meet the needs. So, a request for legal clarity has also shown the possibility of regression. Today, in the debate on public control of state agencies and many laws on exercise of executive power, transparency is often one of the most mentioned subject. Transparency can be assessed as very important values should be pursued in the information society. Because the start of the rule of law is based on a distrust of the closed executive power, the idea of transparency is inherent itself. Furthermore, essential elements of the rule of law, separation of powers, legal reservation, legal stability, trust protection, the principle of clarity, implicitly reflects the idea of transparency. The meaning of the rule of law has been determined in the historical development process in response to the social situation. And tansparency can be said that is a key feature for the implementation of the rule of law. As a result, the idea of transparency should be considered and duly weighed in the discussion for the realization of the rule of law to be the constitutional principle appropriate for modern society.
