일본 근대 저작권 사상이 한국 저작권 법제에 미친 영향

국문 초록

우리 저작권법이 제정된 것은 1957년 1월 28일(법률 제432호)의 일이었다. 반면에 일본은 1899년에 저작권법을 제정함으로써 1999년에 저작권법 제정 100주년을 맞이하였다. 오늘날과 같은 수준의 저작권 보호의식이 국민들 사이에 공감대를 형성하지 못했을 것으로 판단되는 1899년 당시에 일본에서 저작권법 제정을 촉진했던 요인은 무엇이었을까. 나아가 이 같은 일본 저작권법 제정을 부추긴 사상적 맥락이 우리 저작권 법제에 미친 영향은 어떤 것일까. 그리고 오늘날 정착된 우리 저작권 법제에 남아 있는 일본 저작권법의 원형은 어떤 것이 있을까. 이 연구에서는 일본 근대 저작권 사상이 우리 저작권 법제에 미친 영향은 어떠한지 ʻ출판권ʼ을 중심으로 살펴봄으로써 출판의 과거와 현재를 통해 미래를 조망하는 데 연구목적을 두었다. 연구 결과, 일본이 1899년 저작권법을 제정한 배경에는 당시 서구열강과 체결할 수밖에 없었던 불평등조약이 자리 잡고 있음을 알 수 있었다. 일제강점기를 거치며 일본을 통해 서구학문을 간접적으로 흡수함으로써 이 때 유입된 일본서적 등과 함께 ʻ판권ʼ이란 용어가 우리에게도 낯설지 않게 된 것으로 보인다. 이 같은 역사적 배경에도 불구하고 여전히 간기면(刊記面)에 ʻ판권소유ʼ 또는 ʻ판권본사소유ʼ라고 적는 우리 출판계의 관행은 조속히 고쳐져야 할 것이다. 아울러 애초에 그것을 도입했던 일본 저작권법에서는 이미 사라지고 없는 검인첩부 관행 또한 전근대적이고도 시대착오적인 발상이 아닐 수 없다. 이처럼 우리 출판권 관련조항 전반에 걸쳐 잔존하고 있는 일본 저작권법의 영향성을 극복하기 위해서는 한국적 출판문화에 입각한 새로운 패러다임의 구축이 필요하다. 나아가 수천 년 인류문화에 봉사해 온 ʻ책ʼ의 본질을 헤아리는 미래지향적인 법과 제도의 정착을 위한 연구와 실천이 뒤따라야 할 것이다.

영문 초록

The first Korean copyright law was enacted on January 28, 1957, as the No. 432 act. In contrast, Japan already established the copyright law in 1889, and the year 1999 was the 100th anniversary of its copyright law. Unlike these days, there didn't seem to be any consensus among Japanese people about the protection of copyright in 1899. Then there are several questions about that. What urged Japan to legislate for that at that time? How did the philosophical circumstances of Japan that urged the legislation of the copyright law affect our legislative system of copyright? What is the prototype of the Japanese copyright law that remains in our copyright law? The purpose of this study was to examine the impact of the modern copyright thought of Japan on the Korean legislative system of copyright. It's specifically meant to focus on the right of publication to shed light on the past, present times and future of publication. As a result of making an investigation, there was something behind the scenes when Japan enacted the copyright law in 1899. That was the unequal treaty that the country had no choice but to make with Western countries. Our country received Western studies in a secondhand manner through Japan during Japanese occupation, and it seemed that contemporary Korean people got used to the term copyright when they were exposed to Japanese books, etc. Despite such a historical background, Korean publishing companies still put "Copyright reserved" or "CopyrightⒸ. All rights reserved" on the colophon, and this practice should urgently be rooted out. In addition, the practice is premodern and behind the times. There is already no sign of this practice in the Japanese copyright law, although that country introduced it at first. Indeed, the Japanese copy right law still remains influential in the area of the right of publication in our country. To get rid of it, a paradigm shift is required in consideration of Korean publication culture, and intensive research efforts should be made to facilitate the establishment of future-oriented law and systems that prize the value of 'books' that have long made a splendid contribution to human culture for thousands of years.
