2007년 어선원노동협약의 국내수용에 있어서 주요 쟁점사항에 관한 연구

국문 초록

이 논문은 어선원노동협약의 국내수용에 있어서 제기되는 주요 쟁점사항인 적용범위, 승무정원과 휴식시간, 무료급식, 어선원근로감독 등에 대한 연구를 통하여 이 협약의 국내수용 방향을 제시하는 것을 목적으로 한다. 적용범위와 관련하여 어선원과 어선소유자 사이에 노사관계가 성립되지 않거나 승선 어선원의 수가 5인 미만인 어선은 생계형 어로선으로 보아 선원법의 적용을 제외할 것을 제안하였다. 승무정원과 휴식시간에 대해서는 모든 어선에 대하여 적용되는 “안전한 항해와 조업을 위한 충분한 배승”의 원칙과 24미터 이상의 어선에 적용되는 “안전한 항해를 위한 최소승무기준”의 원칙을 정립하고, 앞의 원칙에 의하여 산정되는 선원은 선원명부에 기재하도록 하고, 뒤의 원칙에 의하여 산정되는 최소승무인원은 승무정원증서에 기재하도록 할 것을 제안하였다. 아울러 3일 이상 해상에 머무르는 어선에 적용되는 최소 휴식시간 기준과 이른바 “탄력적 휴식시간제”를 도입할 필요가 있다는 점을 지적하였다. 무료급식에 대해서는 선원법에는 무료급식을 원칙으로 규정하되, 해당 어선 원임금이 비율급제로서 해당 노동조합 또는 관련 선원의 과반수의 동의가 있는 경우에 한하여 예외적으로 식량과 식수의 공급에 사용된 비용을 공동경비에 계상할 수 있도록 하는 방안을 제시하였다. 어선원근로감독과 관련해서는 3일 이상 해상에 머무르는 것으로서 길이 24미터 이상의 어선 등에 대하여 가칭 “어선원노동적합증서”를 발급하고, 이를 위한 검사 제도를 도입하되 그 유효기간은 5년으로 하며, 항만국통제에 의한 불필요한 개입을 피하기 위하여 중간검사는 이를 도입하지 않을 것을 제안하였다. 항만국통제와 관련한 세부적 절차를 마련하기 위하여 최근 ILO에서 개최된 어선원노동협약에 관한 항만국통제지침서 검토를 위한 삼자간 전문가 회의에 서 채택된 항만국통제지침서를 참고하여야 한다는 점을 지적하였다.

영문 초록

This paper intends to propose the direction for implementing the Work in Fishing Convention through studying key issues such as the scope of application, fisher's manning and hours of rest, free food and drinking water, fishers' labour inspection arising from the implementation of the Convention. With respect to the scope of application, it was proposed that the Seafarers' Act should not be applicable to the cases where there is no relationship of worker and employer among the fishers and the fishing vessel owner or there are less than 5 fishers on board as these cases can be regarded as subsistence fishing. Regarding fisher's manning and hours of rest, it was proposed that there is a need to establish the principle of sufficient manning for the safe navigation and operation applicable to all fishing vessels engaged in commercial fishing and the principle of minimum level of manning for the safe navigation applicable to fishing vessels of 24 meters in length and over, and also to enter the number of fishers calculated by the principles of the former in the crew list while the number of fishers calculated by the principles of the latter in the minimum safe manning document. In addition it was also pointed out that there is a need to introduce the standards of minimum hours of rest applicable to fishing vessels remaining at sea for more than 3 days and what is called "the flexible hours of rest system". In respect of free food and water, it was proposed that the Seafarers' Act should stipulate the principle of providing free food and water to fishers unless there is an agreement from the representative union or the majority of fishers concerned where fisher's wage is governed by a share system, in which case the cost of food and water can be recovered as an operational cost. In relation to the fisher's labour inspection, it was proposed that the inspection and issuance system should be introduced in which the tentative name "Fisher Labour Certificate" should be issued to fishing vessels remaining at sea for more than 3 days which are 24 meters in length or over, etc. and the validity of the certificate should be 5 years and no intermediate inspection need to be included in order to avoid unnecessary intervention by the port state control. Finally it was pointed out that the Guidelines for port State control officers carrying out inspections under the Work in Fishing Convention, 2007 (No. 188) adopted by the tripartite meeting of experts held recently in the ILO should be consulted and reflected
