공해조업선에 대한 비선적국의 집행권 행사제도

국문 초록

공해생물자원의 합리적 보존.관리의 필요성과 그 긴급성에 따라 예외적으로 비선적국에 의하여 집행권이 행사되는 제도가 다수의 지역수산기구를 통하여 확립되고 있다. 그리고 공해조업선에 대한 예외적 집행권 행사의 법적 근거를 마련한 일반조약이 1995년의 「유엔 공해어족자원 보존관리규정 이행협정」 이다. 이 논문에서는 공해조업선에 대하여 지역수산기구가 채택한 해양생물자원보존 관리조치의 비선적국에 의한 집행제도 현황을 분석하고, 공해자유원칙의 예외로서의 공해조업선에 대한 비선적국의 승선검색제도를 논의하였다. IUU 어업의 예방.근절을 위한 국제사회의 노력이 강화되고 있는 상황에서, 비록 유엔 공해어족자원 보존관리규정 이행협정 의 비당사국이라 할지라도 협정의 규정들을 무시할 수 없기 때문에 이행협정상의 진보적 규정의 실행은 WCPFC 뿐만 아니라, 기존의 국제수산기구로도 확산될 것으로 전망된 다.

영문 초록

By the necessity and urgency of appropriate conservation and management measures for living resources on the high seas, non-flag state enforcement system is exceptionally being established through several regional fisheries organizations. And the treaty of which made the legal bases of the exceptional non-flag state enforcement system over fishing vessels on the high seas is the 「1995 Agreement for the Implementation of the Provisions of the United Nations Convention on the Law of the Sea of 10 December 1982 Relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks」. In this paper, the status of non-flag state enforcement system of the conservation and management measures for marine living resources over fishing vessels on the high seas, which are adapted by regional fisheries organizations is analysed, and the non-flag state boarding and inspection system over fishing vessels on the high seas is discussed as an exceptional principle of the freedom of the high seas fisheries. At the situation of intensifying international effort for the prevention and eradication of IUU fishing, any states cannot ignore the regulations of the above 「Agreement」, even if they are not the contracting parties of the ｢ Agreement」, so the accomplishment of the progressive regulations of the above 「Agreement」 would be proliferated to the existing international fisheries organizations as well as WCPFC.
