국문 초록

최근 미국은 북한에 대한 테러지원국을 해제하는 등 세계정세는 급변하고 있다. 그러나 여전히 지금도 세계 도처에서는 민족, 종교, 영토문제로 인한 각종 분쟁이 끊이지 않고 발생되고 있으며 대량살상무기와 국제테러의 확산 등으로 국제안보질서 또한 불안정성이 더욱 증대되고 있는 현실이다. 특히 금세기 세계를 충격과 공포에 휩싸이게 하였던 미국 뉴욕 무역센터에 대한 9.11항공기 테러사건은(2001) KAL858기 폭파사건(1987)을 경험하였던 한국입장에서 볼 때는 결코 남의 나라 이야기만은 아닌 상황인 것이다. 더구나 한미동맹 관계에 의해 한국은 2004년 이라크에 한국군을 파병함으로써 일부 이슬람 저항단체의 공격대상이 된바 있으며 이로 인해 2009년 예멘에서 발생하였던 우리국민들 에 대한 폭탄테러등과 같은 테러위협도 점차 고조되고 있는 실정이기 때문에 항공기 납치 등으로 대표되는 공중범죄 예방활동역시 현실에 당면한 중요한 과제로 부각되고 있다. 특히 항공교통의 발달과 범죄 및 테러의 국제화로 인해 항공기를 이용한 테러형태는 이제 테러리스트들의 새로운 공격방법으로 채택되고 있으며 항공기 납치 또한 테러범죄자들에게 또 다른 공격목표를 제공해 주고 있다. 더구나 국가의 통제로부터 벗어난 테러조직이 활동 할 수 있는 것은 무엇보다도 마약거래와 암시장에 넘긴 무기가 이들에게 테러용 자금과 무기를 제공하는 등 테러환경을 조성 할 수 있는 것도 주요원인이기 때문에 테러를 방지하기 위해서는 국가의 부패 환경개선에도 관심을 기울여야 한다. 따라서 본 논문에서는 한국에 있어서의 공중범죄(hijacking)예방을 위한 법적, 제도적 방안을 고찰하여 보았다. 결국 하이재킹 등 공중범죄예방을 위해서는 많은 방법이 있겠지만 우선 제도적으로는 국제협약이나 국내법규이행에 철저를 기하면서 테러리스트들이 기생할 수 없도록 부패환경을 개선하고 경비체제도 부단히 강화하는것이 테러를 방지할 수 있는 방안이라 생각한다.

영문 초록

Today, We have come to rely tremendously on the convenience afforded by air travel. However, as much as advancements in air travel have made lives better and more convenient for us, we cannot fail to look at the other side of the picture. Hijacking became a big issue in Korea in the 1980's with the hijacking of the Air China flight in 1983, terrorism of the Gimpo Airport in 1986 right before the Asian Games, and the hijacking of KAL858 in November 1987. However, from a global aspect, the history of hijacking goes back much further. In short, there needs to be legislation that deals specifically with these threats to aviation security, Prevention plans for Aircraft & Establishing Legal Jurisdiction. This study will look at the structure of a legal system that will aid aviation security and prevent hijacking and implement this system as a legal mechanism for the prevention of terrorism in the air. In general, the hijacking occurs for the following three reasons. (1) To fleer ones country (2) To seek a ransom (3) for political reasons. As aviation technology developed, there was an urgent need for international regulations and the UN's International Civil Aviation Organization(ICAO) held a meeting in Hague from December 1st to 16th 1970 to sign the "Convention for the Suppression of Unlawful Seizure of Aircraft" agreement. In 1963, before the Hague Convention, the "Convention on Offenses and Certain Other Acts Committed on Board Aircraft" (also called the Tokyo Convention). On Sept. 23, 1971, the "Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation" held in Montreal. Hijacking prevention requires both the execution of international and domestic regulations together with the strengthening of security. A powerful and elaborate hijacking prevention policy is the only way to prevent hijacking before it happens.
