국문 초록

테러범죄는 일반적인 개인적 범익을 침해하는 범죄와 달리 불특정 다수인의 생명과 안전을 위협하는 특성을 가지고 있으며 그 규모 또한 예측하기 힘들다는 특징이 있다. 또한 테러 발생 결과 국민의 불안감 증가, 경제에 있어 국제신인도의 하락 및 투자의 위축 등 사회․문화․경제적 파급효과가 발생한다는 것은 불가피한 사실인 것이다. 이러한 테러에 관련한 선행연구가 예방을 중심으로 접근하고 있다면 발생 후 피해자 보호 및 지원에 관한 연구는 미흡하였다. 따라서 본 연구는 이러한 접근에서 탈피하여 테러를 범죄로 규정하고 테러범죄를 피해자측면에서 피해자와 테러범죄의 관계, 테러범죄 사건에 따른 피해자학 분류상 분석, 발생 후 피해자에 대한 지원방안에 대해서 논의하고자 하였다. 지원방안으로 첫째, 테러범죄 피해자에 대해서도 피해자 구조금을 받을 수 있도록 법률 개정이 필요하다. 둘째, 피해자에 대한 피해측정 연구를 통한 피해자에 대한 현실적인 지원 등이 필요하다. 셋째, 범죄피해자지원의 재원확보가 마련되어야 한다.

영문 초록

Terror crimes are characterized by the threat to the life and safety of many and unspecified persons and the unpredictability of their scales, unlike the crimes which infringe the general personal benefit and protection of the law. Also, it is an evitable fact that, owing to the occurrence of terrors, the social, cultural, and economic ripple effects, including the increase of people's anxiety, and the decline of international confidence and the shrinking of investment in economy, are generated. The preceding studies on such terrors focused on the prevention against terrors, whereas the studies on the protection and support for victims after the occurrence of terrors were insufficient. Thus, beyond these approaches, the purpose of this study is to consider terrors as crimes, and so examine terror crimes int eh aspect of victims, and then discuss the relationship between victims and terror crimes, the victimological classification according to terror crime events, and the support measures for victims after the occurrence of terrors. Such support measures are as follows. First, the revision of laws is necessary so that even the victims of terror crimes can receive relief funds for victims. Second, it is necessary to provide victims with the realistic support through the damage measurement research on victims. Third, the financial resources for supporting the victims of crimes should be secured.
