국문 초록

노인범죄는 일반적으로 노년기에 나타나는 이상행동으로 여겨 왔다. 60세 이상이 되면 신체적인 기능의 전반적인 쇠퇴, 정신적 탄력성이나 의지력의 퇴화, 핵가족화로 인한 소외감, 퇴직으로 인한 사회적 고립 등으로 인하여 노인의 심리적 변화가 이상행동으로 나타난 것으로 해석되었다. 최근에는 범죄의 횟수보다는 유형이 다양화되고 때로 청소년층이나 장년층의 범죄에 못지 않은 폭력성과 대담성을 보여주고 있어 심각한 사회문제로 인식되고 있다. 이러한 노인범죄의 원인으로는 특히 경제적 빈곤과 함께 사회로부터의 소외감, 가족과의 불화, 노년의 정서적 변화 등 심리적 원인이 지적되고 있다. 우리가 최근까지 청소년범죄에 대하여 관심을 가지고 대응방안을 마련하였듯이 노령화사회에서는 노인범죄에 대하여 관심을 가지고 대응방안을 마련해야 할 것이다. 그동안 형사사법학계에서 노인범죄는 강력범죄의 비중이 적고 신체적․정신적으로 약하다는 특성상 범죄 행위의 주체가 아니라 피해 대상으로만 보아 왔기 때문에 본 연구는 형사사법적 관점이 아닌 사회복지적 관점에서 노인범죄의 문제에 관하여 접근하였다. 궁극적으로 노인들은 적절한 여가활동을 통해 노후의 고독감 및 고립감을 해소하고 삶에 대한 새로운 의미를 부여하여야 한다. 이를 위하여 노인복지시설을 확충하고 전문가를 배치하여야 함은 물론이고,다양한 자원봉사활동을 통한 사회참여를 유도하여야 할 것이다.

영문 초록

Old man crime have thought as atypical behavior that appear in senescence usually. If is 60-year-old problem general breakdown of physical function, spiritual elasticity or will power of degenerate, was analyzed by thing which psychological change of old man from feelings of alienation by trend toward the nuclear family, social isolation by retirement etc.. appears by atypical behavior. Recently, type is diversified and is realized by serious social problem because is showing violence and daring. The family systems with specially economical poverty as cause of this old man crime be in discord, sentimentalize change etc.. psychological cause in old age is pointing. We will have to be interested about old man crime on aging society and ready confrontation plan as we were interested about juvenile delinquency until the latest and readied confrontation plan. Old man criminal offense is less density of great strength crime in Criminal Justice meantime because have seen only as damage target and not subject of special quality criminal act that is weak spiritually, this study approached about problem of old man crime from Social Welfare viewpoint which Criminal Justice viewpoint is not. Old mans must solved loneliness after string through suitable recreation and sense of isolation and give new meaning about life ultimately. It may have to of course, and drive social activities through various voluntary service that must expand welfare facilities for this and post expert.
