국문 초록

  이 연구의 목적은 장학법인의 설립 및 운영 현황을 분석하고 그 문제점과 개선방안을 제시하는 것이다. 이를 위해 교육과학기술부의 장학법인 현황 자료와 관련법령 분석, 16개 시ㆍ도교육청 공익법인 담당자 회의, 수도권 지역교육청 법인업무 담당자 회의 및 설문조사를 실시하였으며, 제도적 측면, 감독 및 지원적 측면, 운영적 측면에서 문제점을 분석하고 개선방안을 제시하였다. 연구결과 첫째, 제도적 측면에서는 완화된 법인 설립 주의의 채택, 법률과 시행령의 소관부처 통일, 법령의 현실적합성 제고, 공익신탁제도 등의 활성화 등이 필요하다. 감독 및 지원적 측면에서는 감독청의 지도ㆍ감독 강화, 소재지변경에 따른 관리감독체계의 명확화, 법인행정사무의 지원 등이 필요하다. 셋째, 운영적 측면에서는 이사회 구성의 합리화, 사업의 활성화, 장학금 지급률의 제고, 장학금 수혜자 선정의 합리화가 필요한 것으로 나타났다.

영문 초록

  The purpose of this study was to analyze the foundation and operation of financial aid committees, and suggest the improvements.
  In order to achieve the above purpose, analysis of the present condition data(2004-2006) of committees possessed by MOE, several meeting with the persons in charge, analysis of the related laws and regulations and survey method were used.
  From the results of the study, the improvements of four aspects(system, supervision, support, operation) were as follows.
  Firstly, mitigation of the foundation system, unity of the relevant authorities for the related laws and regulations, and raise the realistic appropriateness of the law were suggested in the aspect of system.
  Secondly, strengthening the guidance of the supervisory office, and clarification of the management system for the location change were suggested in the aspect of supervision.
  Thirdly, supporting the administrative work and carrying out the encouragement for Corporations were suggested in the aspect of support.
  Lastly, rationalization of the constitution of governing body, revitalization of the enterprise, improvement of the payment rate of scholarship, rationalization of the selection of scholarship beneficiaries, and revitalization of the charitable trust system were suggested in the aspect of operation.
