영문 초록

  A trend that the quantity of a married couple in sterility increase is appear. Through the progress of bio technology a test tube baby was born. Now artificial insemination is general to everyone.
  It is a traditional opinion that a surrogate mother contract is in invalid on the authority of being against public order.
  But recently, an opinion that a surrogate mother contract is in valid on the authority of constitutional the basic human rights is appear.
  I think that a surrogate mother contract is in valid as long as a married couple in serility and for free. Because a general idea of public order change constantly according to a demand of an age and a society.
  In conclusion, It is desirable to a surrogate mother contract can allow only a married couple in serility and for free.
