영문 초록

The article 245 of the Korean Civil Law provides two types of acquisitive prescription system. The clause 1 of the article 245 is an acquisitive prescription system by possession. The clause 2 of the article 245 is an acquisitive prescription system by registration. To acquire ownership by the clause 2 of the article 245. It is required that good faith, no fault at the beginning of the possession by register book for 10 years. However these conditions additionally required those of the clause 1 of the article 245. This study is on this matter. Especially, it have to construe that the acquirer of acquisitive prescription system in our country may employ the doctrine of tacking. This situation illustrates a tendency of the world-wide. The acquisitive prescription system in our country, its function and the significance of the existence is important where the public confidence of registration is not recognized, so it is necessary that the system is applied the parties rationally.
